HomeMy WebLinkAbout07316ORDINANCE NO. 7316 AN ORDINANCE APPROVING GRANT AGREEMENTS BETWEEN THE CITY OF PUEBLO AND THE U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT (HUD) CONCERNING THE YEAR 2005 HOME PROGRAM AND COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM, AUTHORIZING THE EXECUTION THEREOF BY THE PRESIDENT OF THE CITY COUNCIL, APPROPRIATING ADDITIONAL GRANT FUNDS TO BE RECEIVED THEREUNDER, APPROVING FUNDING FOR PUBLIC SERVICE PROJECTS AND AMENDING ORDINANCE NO. 7260 TO CONFORM THEREWITH BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The Grant Agreements between the U S Department of Housing and Urban Development and the City of Pueblo, which are identified as Grant Number M- 05 -DC -08 -0205 for the HOME Program and B- 05 -MC -08 -0007 for CDBG, copies of which are attached hereto, are hereby approved in all respects. SECTION 2. The President of the City Council is hereby authorized and directed to execute said Grant Agreements in the name of the City and the City Clerk is hereby authorized and directed to attest and impress the official seal of the City of Pueblo on the Grant Agreements. SECTION 3. he City Manager, or his duly authorized representatives, and other officials of the City are hereby authorized and directed to do all things required to be done in order to obtain payments under the Grant Agreements, including, but not limited to, filing requests for payments, contracting with persons and organizations in order to carry out the provisions of the Grant Agreements, filing reports and keeping records relating to fiscal and evaluation matters, and forwarding other materials to the United States of America. SECTION 4. The payments made by the United States of America to the City pursuant to and under the Grant Agreements shall be deposited in the Finance Department of the City and credited to Special Fund Nos. 250 for Community Development Block Grant and 251 for HOME Investment Partnership funds. SECTION 5. Monies received as program income including principal and interest loan repayments, or other sources of private receipts by the fund accounts listed in Section 4 of this Ordinance, shall be deposited in the Finance Department of the City and credited to Fund Nos. 250 and 251, according to the original source thereof. SECTION 6. The recommended projects for Public Services under the crime prevention and youth services activities as shown on Exhibit A are approved. SECTION 7 Ordinance number 7260 adopting the City of Pueblo's One Year Action Plan for the fiscal year 2005 -2006 is amended by appropriating $83,793 in additional CDBG funds to the contingency account CD0527 and $53,493 of HOME housing funds to be appropriated to the City's Rehab /Infill /New Construction program. ISSUE The City Council on January 10, 2005 approved Ordinance number 7260 which submitted the CDBG and HOME FY 2005 application to the U.S. Department of Housing and Urban Development (HUD). HUD approved the application, and the City must now execute the attached grant agreements, appropriate the additional funding received and approve project budgets for previously appropriated public services programs. RECOMMENDATION Approve the ordinance and sign the grant agreement, thereby, allowing City staffto implement the city of Pueblo FY 2005 CDBG and HOME projects identified in the Consolidated Plan. BACKGROUND The City of Pueblo submitted on January 15, 2005, a federal application for CDBG and HOME funds for the year 2005. HUD has approved that FY 2005 application and one year action plan submitted by the city of Pueblo and the city must now enter into a grant agreement. At the time, the application included a line item for youth and crime prevention programs. The Citizen's Advisory Committee (CAC) has since made its recommendations for these programs. Attached to the ordinance as Exhibit A are the recommendations from the CAC. FINANCIAL IMPACT The amount of the Community Development Block Grant funds and HOME finds to be allocated to the City of Pueblo in 2005 is respectively $1,864,800 and $923,773. This is an increase from the budgeted amounts for both grants ($83,793 for CDBG and $53,493 in HOME). Under the proposed ordinance the excess fiords received will be appropriated in the following manner: 1) CDBG funds in the amount of $83,793 will be used to fund the project contingency account CD0527; 2) HOME funds in the amount of $53,493 will be added to the Rehab/Infill/New Construction line item. Notwithstanding any provision of the Grant Agreement, no funds provided under this agreement may be obligated or expended for the planning or construction of water or sewer facilities until receipt of written notification from HUD of the release of funds on completion of the review procedures required under the Executive Order (E.O.) 12372, Intergovernmental Review of Federal Programs, and HUD's implementing regulations at 24 C.F.R. Part 52. The Participating Jurisdiction's /Entity's approved Consolidated Plan submission /Application and the HUD regulations at 24 CFR Part 92 (as is now in effect and as may be amended from time to time) and this HOME Investment Partnership Agreement, form HUD - 40093, including any special conditions, constitute part of this Agreement.
