HomeMy WebLinkAbout07306Reception 1648916 11/21/2005 ORDINANCE NO. 7306 AN ORDINANCE VACATING THE EAST 18 FEET OF DUPPS AVENUE LYING ADJACENT TO BLOCK 2, WOODLAND SUBDIVISION AND ACCEPTING A DEDICATION OF LAND FOR STREET PURPOSES BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: SECTION 1. The east 18 feet of Dupps Avenue lying adjacent to Block 2, Woodland Subdivision and more particularly described as follows: A parcel of land located in the Northeast one - quarter of the Southeast one - quarter of Section 34, Township 20 South, Range 65 West of the 6 th Principal Meridian, being more particularly described as follows: All of the East 18 feet of Dupps Avenue lying adjacent to Block 2, Woodland, according to the recorded plat thereof, filed for record November 7, 1890 in Book 6 at Page 47 of the Pueblo County Clerk and Recorder, State of Colorado: is hereby vacated. SECTION 2. The dedication of the following dedicated land for street purposes is accepted and approved: A parcel of land located in the Northeast one - quarter of the Southeast one - quarter of Section 34, Township 20 South, Range 65 West of the 6 th Principal Meridian, being more particularly described as follows: A parcel of land located within Woodland, according to the recorded plat thereof, filed for record November 7, 1890 in Book 6 at Page 47 of the Pueblo County Clerk and Recorder, State of Colorado being more particularly described as follows: Beginning at a point on the Southerly Right -of -Way line of Nuckolls Avenue, said point being 9.76 feet from the Northeast corner of Lot 23, Block 2, said Woodland; Thence Westerly and along said Southerly Right -of -Way a distance of 58.24 feet to the Westerly line of Vacated Dupps Avenue; Thence Southerly and parallel with the Westerly Right -of -Way line of Dupps Avenue, a distance of 30.19 feet; Thence Northeasterly, through said Dupps Avenue and Lots 23 & 24, of said Block 2, a distance of 65.60 feet, more or less, to the Point of Beginning. 111�1111111 III 1I Pa ge: 64 of 2 Q Chris C. RECOMMENDATION The Planning and Zoning Commission, at their March 9, 2005 Regular Meeting, voted 7 -0 to recommend approval. BACKGROUND The applicant intends to construct a single - family residence on two (2) vacant lots at the west end of Block 2, Woodland Subdivision. To date, the rights -of -way adjoining the lots have not been improved. Concurrent with the construction of the residence the Applicant must make improvements to Nuckolls Avenue, Dupps Avenue and the alley. Given the nature of the improvements it has been determined that the City does not need the eastern 18 feet of Dupps Avenue adjoining the applicant's property to construct the new right -or -way improvements. The applicant will separately dedicate a triangular shaped parcel for right -of -way purposes to accommodate Nuckolls Avenue improvements. It is the recommendation of the Subdivision Review Committee (SRC) that the vacation be approved. FINANCIAL IMPACT None.
