HomeMy WebLinkAbout07296ORDINANCE NO. 7296 AN ORDINANCE CHANGING ZONING RESTRICTIONS FROM R -5 TO B -3 COVERING A PARCEL OF LAND COMMONLY KNOWN AS 1600 FORTINO BOULEVARD WEST BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The zoning restrictions covering the following described property be changed from R -5, Multiple - Residential and Arterial Business District to B -3, Highway and Arterial Business District, and upon passage of this ordinance, zoning restrictions affecting B -3, Highway and Arterial Business District shall apply to said property: LOTS 4 and 5, BLOCK 2, GATEWAY SUBDIVISION, 5 FILING, and more commonly known as: 1600 FORTINO BOULEVARD WEST. SECTION 2. This ordinance shall become effective immediately upon final passage and approval. RECOMMENDATION The Planning and Zoning Commission, at their February 9, 2005 regular meeting, voted 6 -0 to recommend approval. BACKGROUND Research indicates that this parcel was once zoned B -3, Highway and Arterial Business District, then the subject properties were rezoned to R -5, Multiple - Residential and Office District, in 1998 to provide for the construction of a 70 unit assisted living facility. Plans for the assisted living facility never materialized and the property remains vacant. It is the intention of the applicant to rezone the properties back to a B -3 designation and consolidate them with the adjoining Lots 6 and 7 into a new commercial development. FINANCIAL IMPACT None.
