AN ORDINANCE CHANGING ZONING RESTRICTIONS FROM 1 -2 TO B -4 COVERING A PARCEL
OF LAND COMMONLY KNOWN AS THE NORTHWEST CORNER OF WEST 4 STREET AND
NORTH ELIZABETH STREET
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The zoning restrictions covering the following described property be changed from 1 -2, Light
Industrial District and upon passage of this ordinance, zoning restrictions affecting to B -4, Regional
Business District shall apply to said property:
A parcel of land located within a portion of Blocks 18 and 19 and a portion of the vacated alleys within,
State Addition to Pueblo, according to the recorded plat thereof, filed for record January 28, 1878 in
Book 2A at Page 6 in the records of the Pueblo County Clerk and Recorder and a portion of vacated
W. Fifth Street adjacent thereto, located within a portion of the NE 1/4 of Section 36, Township 20
South, Range 65 West of the Sixth Principal Meridian being more particularly described as follows:
BEGINNING at the SE corner of said Block 18; thence westerly along the southerly line of said Block
18, a distance of 88 feet, more or less, to a point on the southwesterly right -of -way line of the
abandoned Atchison, Topeka and Santa Fe Railway; thence northwesterly along said southwesterly
right -of -way line, a distance of 330 feet, more or less, to a point on the easterly right -of -way line of
vacated West Street according to City Ordinance No. 1161 which was passed and approved on
January 7, 1924; thence northerly along said easterly right -of -way line, a distance of 266 feet, more
or less, to a point on the centerline of the vacated Alley within said Block 19, according to City
Ordinance No. 2529 which was introduced December 14, 1959; thence easterly along the said
centerline of vacated Alley within Block 19, a distance of 132 feet, more or less, to a point of the
easterly line of Lot 11 and the easterly line of Lot 11 extended northerly of said Block 19; thence
southerly along the said easterly lines of Lot 11 and Lot 11 extended, a distance of 115 feet, more or
less to a point on the northeasterly right -of -way line of the said abandoned Atchison, Topeka and
Santa Fe Railway; thence southeasterly along said northeasterly right -of -way line, a distance of 21
feet, more or less, to a point on the northerly right -of -way line of vacated W. Fifth Street, according to
City Ordinance No. 71 which was passed and approved on July 11, 1887; thence easterly along said
northerly right -of -way line of vacated W. Fifth Street, a distance of 203 feet, more or less to a point on
the westerly right -of -way line of Elizabeth Street; thence southerly along the said westerly right -of
way line, a distance of 80 feet, more or less to the NE corner of said Block 18; thence westerly along
the northerly line of said Block 18, a distance of 88 feet, more or less to a point on the westerly line of
Lot 2 and the westerly line of Lot 2 extended southerly, a distance of 128 feet, more or less to a point
on the centerline of the vacated Alley within said Block 18, according to City Ordinance No. 1878
which was passed and approved on August 3, 1953; thence easterly along said centerline of vacated
Alley within Block 18, a distance of 88 feet, more or less to a point on the said westerly right -of -way
line of Elizabeth Street; thence southerly along said westerly right -of -way line, a distance of 128 feet,
more or less, to the POINT OF BEGINNING.
Said Parcel contains 2.25 acres, more or less,
and more commonly known as:
NORTHWEST CORNER OF WEST 4TH STREET AND NORTH
ELIZABETH STREET.
SECTION 2.
This ordinance shall become effective immediately upon final passage and approval.

ISSUE
Shall City Council approve a request to rezone the property from an 1 -2, Light
Industrial District to a B-4, Regional Business District?
RECOMMENDATION
The Planning and Zoning Commission, at their February 9, 2005 regular
meeting, voted 5 -0 to recommend approval.
BACKGROUND
The applicant requests rezoning for the subject property to align the zoning with
the adjacent uses and zone district.
FINANCIAL IMPACT
None.
