HomeMy WebLinkAbout07267ORDINANCE NO. 7267 AN ORDINANCE AMENDING THE PUEBLO REGIONAL COMPREHENSIVE DEVELOPMENT PLAN — 2002 TO INCLUDE A RECREATIONAL AND TOURISM USES ELEMENT AS REQUIRED BY COLORADO REVISED STATUTES SECTIONS 30 -28 -106 AND 31 -23 -206 WHEREAS, the Colorado Revised Statutes Sections 30 -28 -206 and 31 -23 -206 relating to the adoption and content of Master Plans for cities and counties, was amended on November 6, 2001 to include a requirement that Master Plans contain a recreational and tourism uses element, and WHEREAS, in response to this mandate, the Pueblo Area Council of Governments ( PACOG) commissioned a recreation and tourism study for the PACOG area, which is inclusive of all of Pueblo County, and WHEREAS, the Planning and Zoning Commission pursuant to Section 12 -5 of the City Charter recommends that the Pueblo Regional Comprehensive Development Plan — 2002 be amended to include the Recreation & Tourism Element of Pueblo's Comprehensive Plan, and WHEREAS, the City Council does hereby find and determine that the Pueblo Regional Comprehensive Development Plan — 2002 should be amended to include the Recreation & Tourism Element of Pueblo's Comprehensive Plan, and WHEREAS, the City Council does hereby further find and determine that such an amendment would be in furtherance of and consistent with Pueblo Regional Comprehensive Development Plan. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The Pueblo Regional Comprehensive Development Plan is hereby amended to include the Recreation & Tourism Element of Pueblo's Comprehensive Plan in compliance with Colorado Revised Statutes Sections 30 -28 -206 and 31 -23 -206. SECTION 2. The Pueblo Regional Comprehensive Development Plan -2002 heretofore adopted and approved by the City Council together with the modification thereto set forth in Section 1 hereof are advisory only and shall apply to all land located within the jurisdictional boundaries of the City. SECTION 3. This Ordinance shall become effective upon final passage and approval. RECOMMENDATION The Planning and Zoning Commission at their June 9, 2004 Regular Meeting voted 6-0-0 to recommend approval of the proposed amendment. Following the revision of the plan to address the concerns of the Greater Pueblo Chamber of Commerce, the Planning and Zoning Commission at their December 8, 2004 Regular Meeting voted 5-0-0 to recommend approval of the proposed amendment with the changes included that addressed the Chamber of Commerce's concerns. BA CKGROUND The Colorado Revised Statutes Sections 30- 28-206 and 31 -23 -206 relating to the adoption and content of Master Plans for cities and counties was amended on November 6, 2001 to include a requirement that Master Plans contain a recreational and tourism uses element. In response to this mandate, the Pueblo Area Council of Governments ( PACOG) commissioned a recreation and tourism study for the PACOG area. The "Recreation & Tourism Element° was prepared in February, 2004 by GreenPlay, LLC a private consultant. The text amendment sets forth the adoption of a plan that identifies the recreational and tourism needs of residents of the county and visitors to the county through delineated areas dedicated to, without limitation, hiking, mountain biking, rock climbing, skiing, cross country skiing, rafting, fishing, boating, hunting, shooting, or any other form of sports or other recreational activity, as applicable, and commercial facilities supporting such uses. At the public hearing on the ordinance to amend the Pueblo Regional Comprehensive Plan 2002 to include a Recreational and Tourism Uses Element, the staff from the Greater Pueblo Chamber of Commerce (Chamber) expressed concerns about including more data and information about tourism within the Pueblo Region, as well as more details on the Chamber's ongoing efforts to promote tourism within the region. Based on these concerns, the City planning staff met with staff from the Chamber and provided revisions to the Recreation and Tourism Plan to the project consultant. These changes have been incorporated into the revised plan and endorsed by the Chambers Executive Director, Rod Slyhoff. FINANCIAL IMPACT None.
