ORDINANCE NO. 7254
AN ORDINANCE APPROVING THE REGENCY CREST
SUBDIVISION, FILING NO. 2, A SPECIAL AREA PLAN,
1 ST AMENDMENT SPECIAL AREA PLAN
WHEREAS, The Regency Crest Subdivision, Filing No. 2. A Special Area Plan,
1 St Amendment Special Area Plan has been submitted to the Planning and Zoning
Commission for approval pursuant to Section 17 -4 -29 of the Pueblo Municipal Code,
and
WHEREAS, the Planning and Zoning Commission after a public hearing found
and determined the objectives and requirements of said Section 17 -4 -29 can and will be
met, and
WHEREAS, the Planning and Zoning Commission has recommended the
approval of The Regency Crest Subdivision, Filing No. 2, A Special Area Plan, 1St
Amendment Special Area Plan without conditions;
NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 2.
The Regency Crest Subdivision, Filing No. 2, A Special Area Plan, 1St
Amendment Special Area Plan being a special area plan of land described as follows:
Lots 4, 5 and 6, Block 2, Regency Crest Subdivision, Filing No. 2, A Special Area Plan,
County of Pueblo, State of Colorado.
AND
Parcel A of Rearrangement of Property Boundaries of Lots 7, 8, 9 and 10, Block 2,
Regency Crest Subdivision, Filing No. 2, A Special Area Plan, County of Pueblo, State
of Colorado, as recorded at Reception No. 1541064 of the records of the Pueblo County
Clerk and Recorder.

Colorado, as recorded at Reception No. 1541063 of the records of the Pueblo County
Clerk and Recorder.
is hereby approved.
SECTION 2.
After considering the recommendation of the Planning and Zoning Commission,
the City Council finds and determines that the Special Area Plan includes and provides
for park and recreation facilities necessary to serve the proposed subdivision or
development and the future residents thereof.
SECTION 3.
This ordinance shall be approved upon final passage but shall not become
effective until (a) the Ordinance approving the Plat of The Regency Crest Subdivision,
Filing No. 2, A Special Area Plan, 9 s1 Amendment becomes effective pursuant to
Section 4 of that Ordinance, and (b) the final plat for the special area plan hereby
approved is recorded in the office of the Pueblo County Clerk and Recorder.

FILING NO. 2, A SPECIAL AREA PLAN, 1 AMENDMENT SPECIAL AREA

ISSUE
Shall City Council approve a request to amend the Special Area Plan for this
property to allow changes in lot boundaries addressed in the concurrent
subdivision case?
RECOMMENDATION
The Planning Commission, at their November 10, 2004 Regular Meeting, voted
5 -0 to recommend approval.
BACKGROUND
Regency Crest Subdivision, Filing No. 2, A Special Area Plan, 1 Amendment, is
generally located on the southside of Pueblo, west of Cherrycrest Drive and north
of Red Creek Springs Road. The applicant wishes to develop seven building sites
as a special area plan and will cover 1.6249 acres. The plan amends the
previously approved Special Area Plan validating prior arrangements of property
boundaries and resubdivision of three (3) lots into two (2) lots for single - family
homes. This application was submitted concurrently with Subdivision S -04 -14
was also approved unanimously.
Public Works staff confirmed that the applicant has complied with all items listed
in the Subdivision Review Committee memo dated December 1, 2004.
