HomeMy WebLinkAbout07252ORDINANCE NO. 7252 AN ORDINANCE CHANGING ZONING RESTRICTIONS FROM A -4 TO R -2 COVERING A PARCEL OF LAND COMMONLY KNOWN AS SOUTH OF SIENA DRIVE, EAST OF BANDERA BOULEVARD, AND NORTH OF COLORADO STATE HIGHWAY NO. 78 BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The zoning restrictions covering the following described property be changed from A -4, Agricultural One to an District, to R -2, Single - Family Residential District, and upon passage of this ordinance, zoning restrictions affecting R -2, Single - Family Residential District shall apply to said property: A portion of the Arkansas Valley Conduit, being 60 feet in width located in the NW' /4 of Section 16, Township 21 South, Range 65 West of the 6 th P.M., lying North of the Northerly right -of -way line of Colorado State Highway No. 78, in the County of Pueblo, State of Colorado and being more particularly described as follows: Considering the North line of the NW '/4 of Section 16, Township 21 South, Range 65 West of the 6 th P.M. to bear S. 88 °36'21" E., and all bearings contained herein being relative thereto. Commencing at the NW Corner of Section 16; thence S. 88 0 36'21" E., a distance of 710.75 feet to a point on the Easterly right -of -way line of the Arkansas Valley Conduit as presently located; thence Southerly along the arc of a curve to the right whose radius is 444.29 feet and whose center bears S. 58 0 19'15" W., a distance of 49.55 feet; thence S. 25 0 17'21" E., continuing along the said Easterly right -of -way line, a distance of 227.98 feet to the Point of Beginning; thence continuing along the said Easterly right -of -way line the following four (4) courses: 1. S. 25 0 17'21" E., a distance of 4.18 feet; 2. Southeasterly along the arc of a curve to the left whose radius is 442.50 feet a distance of 513.58 feet; 3. N. 88 0 12'39" E., a distance of 186.80 feet; 4. Southerly along the arc of a curve to the right whose radius is 214.06 feet a distance of 161.13 feet to a point on the Northerly right -of -way line of Colorado State Highway No. 78 as presently located; thence S. 52 0 29'39" W., along the said Northerly right -of -way line; a distance of 61.63 feet said point also being on the Westerly right -of -way line of the Arkansas Valley Conduit as presently located; thence along the said Westerly right -of -way line the following three (3) courses: 1. Northwesterly along the arc of a curve to the left whose radius is 154.06 feet and whose center bears S. 36 0 54'00" W., a distance of 104.03 feet; 2. S. 88 0 12'39" W., a distance of 186.80 feet; 3. Northwesterly along the arc of a curve to the right whose radius is 502.50 feet, a distance of 562.83 feet; thence N. 42 0 18'09" E., a distance of 64.45 feet to the Point of Beginning. RECOMMENDATION The Planning and Zoning Commission, at their November 10, 2004 Regular Meeting, voted 5 -0 to recommend approval of the rezoning. BACKGROUND The applicant is requesting a map amendment to rezone a 1.184 acre parcel from A-4, Agricultural Four District to R -2, Single - Family Residential District. Generally located on the south side of Pueblo, south of Siena Drive, east of Bandera Boulevard, and north of Colorado State Highway No. 78. The developer proposes incorporating this 60 -foot strip of land into the future Forest Glenn Subdivision. The Planning and Zoning Commission also voted 5 -0 to recommend approval of the concurrent subdivision plat (S- 04 -16). FINANCIAL IMPACT None.
