The utility easements located within Lots 4 and 5, Block 14; Lots 3 and 4, Block 15; and Lots 2, 3 and 4, Block 16, Eagleridge Estates and more particularly described as follows: All of the 5 foot side lot Utility Easements located in Lots 4 and 5, Block 14, AND All of the 5 foot side lot Utility Easements located in Lots 3 and 4, Block 15, AND All of the 5 foot side lot Utility Easements located in Lots 2, 3 and 4, Block 16, all being in Eagleridge Estates, according to the recorded plat thereof, as filed for record November 8, 2001. are hereby vacated. RECOMMENDATION The Planning and Zoning Commission, at their October 13, 2004 Regular Meeting, voted 6 -0 to recommend approval. BACKGROUND The applicant is requesting the vacation of utility easements in order to resubdivide a portion of the Eagleridge Estates Subdivision. It is the recommendation of the Subdivision Review Committee memo dated September 22, 2004 that the vacation be approved. FINANCIAL IMPACT None
