HomeMy WebLinkAbout07231ORDINANCE NO. 7231 AN ORDINANCE CHANGING ZONING RESTRICTIONS FROM 1 -3 TO S -1 COVERING A PARCEL OF LAND COMMONLY KNOWN AS "PARCEL A" IN RIVER'S RUN SUBDIVISION, NORTH CORNER OF THE JOPLIN AND PORTLAND AVENUE INTERSECTION BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The zoning restrictions covering the following described property be changed from 1 -3, Heavy Industrial District, to S -1, Governmental Use District, and upon passage of this ordinance, zoning restrictions affecting S -1, Governmental Use District shall apply to said property: "Parcel A" River's Run Subdivision, and more commonly known as: North corner of the Joplin Avenue and Portland Avenue intersection; a.k.a. former Walter's Brewery SECTION 3_ This ordinance shall become effective immediately upon final passage and approval. RECOMMENDATION The Planning and Zoning Commission, at their October 13, 2004 Regular Meeting, voted 6 -0 to recommend approval. BACKGROUND Generally located at the north corner of the Joplin Avenue and Portland Avenue intersection; a.k.a. former Walter's Brewery, the development is intended to be a mixed use development comprised of single family, multi - family, business, business park and public park and right -of -way. It has been determined that the legal description for the original zoning case did not include the rezoning of the park property that will be dedicated to the City when the property is subdivided. In order to "clean up" this omission, the rezoning of the park property is presented separately. The Planning Commission voted 5 -0 at their September 8, 2004 to recommend approval of the associated rezoning (Z- 04 -15) application for the bulk of the property. FINANCIAL IMPACT None
