AN ORDINANCE CHANGING ZONING RESTRICTIONS FROM B -1 TO B -2 COVERING A
PARCEL OF LAND COMMONLY KNOWN AS 505 SOUTH PRAIRIE AVENUE
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The zoning restrictions covering the following described property be changed from
B -1, Neighborhood Business District, to B -2, Subregional Business District, and upon
passage of this ordinance, zoning restrictions affecting B -2, Subregional Business District
shall apply to said property:
EAST 62.53 FEET OF LOTS 45 THRU 50, BLOCK 1, WEST POINT
SUBDIVISION,
and more commonly known as:
505 SOUTH PRAIRIE AVENUE.
SECTION 2_
With the recommendation of the Planning and Zoning Commission, this zoning ordinance is
approved with the following conditions:
1. Conditions approved by the Zoning Board of Appeals in Case # ZBA-
043 -2004 shall be complied with during construction.
2. The revised site plan shall be adhered to during construction.
The City Planning and Zoning Commission is hereby authorized and directed to initiate
proceedings to rezone the above - described property to a B -1, Neighborhood Business District, if
the property owners or its heirs, successors or assigns fail to meet these conditions within six (6)
months of passage of this ordinance.
SECTION 3.
This ordinance shall become effective immediately upon final passage and approval.

ISSUE
Shall City Council approve a request to rezone the property from a B -1,
Neighborhood Business District to a B -2, Sub - regional Business District?
RECOMMENDATION
The Planning and Zoning Commission voted 5 -0 to recommend approval at their
June 9, 2004 meeting.
BACKGROUND
The applicant requests that the subject property be rezoned to allow for an
addition to the existing Sunset Inn restaurant. The present owner,. Charles
Chavez, acquired the existing Sunset Inn in 1980. The subject property was
acquired by the applicant with the intent of expanding the current restaurant.
After renovations, the expanded restaurant would have a seating occupancy of
92 persons.
A restaurant is a Use by Right in a B -02 Zone District. Rezoning is necessary in
this case to bring the existing restaurant into compliance with PMC Title 17. The
applicant was recently granted a variance from the parking requirements for the
proposed restaurant in the Zoning Board of Appeals Case # ZBA- 043 -2004. A
number of conditions were attached to approval of this variance.
As a part of the proposed expansion, a small house, a garage, and the former
State Farm Insurance building will be removed from the site.
The attached revised site plan provides for the requirements set by conditions of
approval set by the Planning and Zoning Commission. Please see the attached
memos addressing parking and landscaping.
Staff recommends approval of this request. The applicant has been amenable
to staff suggestions and worked with staff to develop an appropriate site plan
that will enhance the overall character of the neighborhood and be a positive
investment to the community.
