AN ORDINANCE CHANGING ZONING RESTRICTIONS FROM B -3 TO BP COVERING A
PARCEL OF LAND COMMONLY KNOWN AS LOTS 3 AND 7, EAGLECROSS SUBDIVISION 7 T "
FILING WHICH IS LOCATED 0.15 MILES NORTH OF THE INTERSECTION OF EAGLERIDGE
BOULEVARD AND EAGLERIDGE CIRCLE
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1 _
The zoning restrictions covering the following described property be changed from B -3,
Highway and Arterial Business District, to BP, Business Park District and upon passage of this
ordinance, zoning restrictions affecting to BP, Business Park District shall apply to said property:
Lots 3 and 9, Block 1, Eaglecross Subdivision 7 th Filing,
and more commonly known as:
0.15 miles north of the intersection of Eagleridge Boulevard and
Eagleridge Circle.
SECTION 2.
With the recommendations of the Planning and Zoning Commission, this zoning ordinance
is approved with the following conditions:
(1) Subject to the conditions of the variance granted by the Zoning Board of
Appeals (ZBA- 034 - 2004).
(2) The property owner shall provide a site plan and indicate how the proposed
development will address the existing easements on the property.
(3) The proposed building be connected via a sidewalk to the sidewalk in the public
R.O.W. Internal continuous sidewalks of at least five (5) feet wide (clear) shall
be provided from the public street to the entrance, and shall feature adjoining
landscaped areas to provide a separated and pedestrian - friendly access route
for no less than fifty percent (50 %) of their overall length. Additionally, they
shall be visually distinct from the driving surface by the use of pavers, bricks or
scored concrete.
The City Planning and Zoning Commission is hereby authorized and direct to initiate
proceedings to rezone the above - described property to a B -3, Highway and Arterial Business
District, if the property owners or his heirs, successors or assigns fail to meet these conditions
within six (6) months of passage of this ordinance.
SECTION 3_
This ordinance shall become effective immediately upon final passage and approval.

ISSUE
Shall City Council approve a request to rezone the property from a B -3, Highway
and Arterial Business District to a BP, Business Park District to allow for
commercial development?
RECOMMENDATION
The Planning and Zoning Commission voted 6 -0 to recommend approval with
the following conditions:
1. Subject to the conditions of the variance granted by the Zoning Board of

BACKGROUND
The applicant is requesting that the property be rezoned from a B -3, Highway
and Arterial Business District to a BP, Business Park District. Lots 3 and 7 within
Block 1, Eaglecross Subdivision 7 th Filing are located 0.15 miles north of the
intersection of Eagleridge Boulevard and Eagleridge Circle. Schuster's Printing
will be located on Lot 3. The property owner, Eagle Pointe LLC, is requesting to
rezone the property to increase intensity of the use allowed. No opposition to this
application was presented and the Planning Commission approved the rezoning
6 -0.
