AN ORDINANCE AMENDING CHAPTER 4, TITLE IV, OF THE PUEBLO MUNICIPAL CODE
RELATING TO PLUMBING REGULATIONS; ADOPTING BY REFERENCE THE UNIFORM
PLUMBING CODE, 2003 EDITION, TOGETHER WITH THE UNIFORM SWIMMING POOL,
SPA, AND HOT TUB CODE, 2003 EDITION, UNIFORM SOLAR ENERGY CODE, 2003
EDITION, ALL PROMULGATED AND PUBLISHED BY THE INTERNATIONAL
ASSOCIATION OF PLUMBING AND MECHANICAL OFFICIALS, 5001 E. PHILADELPHIA
ST., ONTARIO, CA 91761 -2816; AND THE NATIONAL FIRE PROTECTION ASSOCIATION,
STANDARD "24" INSTALLATION OF PRIVATE FIRE SERVICE MAINS AND THEIR
APPURTENANCES, 2002 EDITION, PUBLISHED BY THE NATIONAL FIRE PROTECTION
ASSOCIATION, BATTERYMARCH PARK, QUINCY, MASSACHUSETTS 02269; PROVIDING
FOR PENALTIES FOR VIOLATIONS OF THE PROVISIONS OF THESE CODES; AND
PROVIDING FOR A PUBLIC HEARING TO CONSIDER THE ADOPTION OF SUCH CODES
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that:

SECTION 1.
Section 1, Chapter 4, Title IV of the Pueblo Municipal Code of the City of Pueblo is
amended to read as follows:
4 -4 -1: UNIFORM PLUMBING CODE -- ADOPTION BY REFERENCE
(a) The Uniform Plumbing Code, [1997] 2003 edition, including all appendices,
tables and installation standards, promulgated and published by the International Association
of Plumbing and Mechanical Officials, [20001 Walnut Drive South, Walnut, California 91789-
2825] 5001 E. Philadelphia St., Ontario, CA 91761 -2816 herein referred to as Plumbing
Code or U.P.C., as amended by this Chapter, together with the minor codes entitled, "Uniform
Swimming Pool, Spa and Hot Tub Code," (U.S.P.S.H.T.C.), [1997] 2003 edition, published by
the International Association of Plumbing and Mechanical Officials, [20001 Walnut Drive
South, Walnut, California 91789 -2825] 5001 E. Philadelphia St., Ontario, CA 91761 -2816
and the Uniform Solar Energy Code (U.S.E.C.), [1997] 2003 edition, published by the
International Association of Plumbing and Mechanical Officials, [20001 Walnut Drive South,
Walnut, California 91789 -2825] 5001 E. Philadelphia St., Ontario, CA 91761 -2816 and the
National Fire Protection Association (N.F.P.A.), Standard "24" Installation of Private Fire
Service Mains and Their Appurtenances, [1995] 2002 edition, published by the National Fire
Protection Association, Batterymarch Park, Quincy, Massachusetts 02269, are hereby
adopted and enacted by reference, and made a part hereof as if set forth in full; provided,
however, that the following portions of the U.P.C. are not adopted and are expressly deleted:
Table 1 -1 entitled "Plumbing Permit Fees," Chapter 5 entitled "Water Heaters,"
Chapter 12 entitled "Fuel Piping," Chapter 13 entitled "Medical Gas Systems,"
and including Appendix G entitled "Graywater Systems for Single Family
Dwellings," Appendix J entitled "Reclaimed Water Systems for Non - Residential
Buildings, Appendix K entitled "Private Sewage Disposal Systems," [and]
Appendix L entitled "Alternate Plumbing Systems" and Appendix E entitled
"Manufactured /Mobile Home Parks And Recreational Vehicle Parks.
Copies of these Codes are available in the office of the Regional Building Department for
distribution and sale to the public. All plumbing and drainage pipes, equipment and systems
or parts thereof within the City shall be regulated by and installed, constructed, altered and
repaired in conformance with the terms and provisions of this Chapter and the Uniform
Plumbing Code, [1997] 2003 edition, herein adopted by reference, except as the same may
be excluded from and specifically not covered by this Chapter and said Uniform Plumbing
Code.
SECTION 2.
Section 2, Chapter 4, Title IV of the Pueblo Municipal Code is hereby amended to
read as follows:
4 -4 -2: AMENDMENTS TO THE UNIFORM PLUMBING CODE
(a) Section 102.1 of the U.P.C. entitled "[Administrative Authority] Authority
Havina Jurisdiction" is amended to read as follows:
"Administration and enforcement of this Code and all related codes are
delegated to the Pueblo Regional Building Department."
(b) " Section 102.3 of the U.P.C. entitled "Violations and Penalties" is amended to
read as follows:
"Any person, firm, or corporation violating any of the provisions of this
Code, upon conviction shall be punished as provided in Section 4 -4 -9
of the [1971 Code of Ordinances of the City of] Pueblo Municipal Code
The application of any such penalty shall not be held to prevent the
enforced removal of prohibited conditions."

(c) Section 103.4.1 of the U.P.C. entitled "Permit Fees" is amended to read as
"Fees shall be as set in the fee schedule adopted by the City Council."
(d) Section 103.4.2 of the U.P.C. entitled "Plan Review Fees" is amended to read
as follows:
"Fees shall be as set in the fee schedule adopted by the City Council."
(e) Section 103.5.6 of the U.P.C. entitled "Reinspections" the fourth Paragraph is
amended to read as follows:
"To obtain reinspection, the applicant shall file a written application
upon a furnished form and pay the reinspection fee as set in the fee
resolution adopted by the City Council."
(f) The Uniform Plumbing Code is amended by the addition of new Section to
read as follows.
"Section 104.0 "Plumbing Board of Appeals." There is hereby
created a Plumbing Board of Appeals to perform the functions set
forth in Chapter 1 of Title IV of the [1971 Code of Ordinances of the
City of] Pueblo Municipal Code
(g) Section 202.0 of the U.P.C. entitled "Definition of Terms." The following terms
are amended to read as follows:
"[Administrative Authority] Authority Having Jurisdiction - as defined in Section
102.1 of this Code as amended.
"Plumbing" is the practice, materials and fixtures used in the installation,
maintenance, extension and alteration of all piping, fixtures, appliances and
appurtenances in connection with any of the following: sanitary or storm
drainage facilities, the venting systems and the public or private water supply
systems within or adjacent to any buildings, structure, or conveyance; also the
practice and materials used in the installation, maintenance, extension or
alteration of stormwater, liquid waste or sewerage, and water supply systems
of any premises from the public water main or other acceptable source of water
supply to its connection with any point of public disposal or other acceptable
disposal system.
"Plumbing system" means and includes all potable water supply and
distribution pipes, all plumbing fixtures and traps, all drainage and vent pipes
and all building drains, including their respective joints and connections,
devices, receptacles and appurtenances within the property lines of the
premises, and shall include potable water piping, potable water treating or
water - connected equipment."
(h) Section 202.0 of the U.P.C. entitled "Definition of Terms" is amended to include
the term jurisdiction which shall be defined as follows:
"Jurisdiction shall mean the City Council as defined in Section 4 -1 -2 of the
[1971 Code of Ordinances] Pueblo Municipal Code
(i) Section 305.0 "Sewers Required" is amended by the addition of a new Section
to read as follows:
"Section 305.4 Taps made to existing sanitary sewers for building sewers
draining into the existing sanitary sewer system of the City shall be made by an
approved mechanical cutting device and an approved saddle or by removing a
section of sewer pipe, and the installation of a new pipe section or sections
with a wye saddle and an approved coupling to make the joint at the juncture
of the new pipe with the existing system. Such work shall be done by either a
Plumbing Contractor or Plumbing Utility Contractor who is licensed to do such
work as provided by Title IV, Chapter 1 of the [1971 Code of Ordinances of the
City of] Pueblo Municipal Code Connections to new sanitary sewers or newly
repaired sanitary systems and installations of building sewers from the main
sewer to the building drain (as required by Section 305.0) shall be installed by
a Plumbing Contractor or a Plumbing Utility Contractor who is licensed to do
such work. When a sewer main is installed in the street or alley right -of -way,
the building sewer, as defined in this Code, shall be installed to the property
line and properly marked with magnetic ductile tape for the full length of said
sewer line. Building sewers, including each tap and wye, shall be inspected by
personnel of either the Pueblo Regional Building Department or the
[Engineering Division of] the City Department of [Public Works] Wastewater

0) Section 413.1 of the U.P.C. entitled "Fixture Count" is amended to read as
"Each building shall be provided with sanitary facilities as prescribed in Table
4 -1 of this Code as amended."
(k) Section 413.2 of the U.P.C. entitled "Access to Fixtures" is deleted.
(1) Section 413.3 of the U.P.C. entitled "Separate Facilities" the " Exceptions " is
[deleted] amended to read as follows
Residential installations.
A single restroom may be provided for both sexes and service sinks
may be eliminated for the following:
a. Mercantile Occupancies of two thousand (2,000) square feet or
fewer and have no food service and usable by both the public and employees.
b. Office, Medical and Dental clinics of one thousand (1,000)
square feet or fewer and usable by both the public and employees.
(m) Section 413.4 of the U.P.C. entitled "Fixture Requirements for Special
Occupancies" is deleted.
(n) Section 413.5 of the U.P.C. entitled "Facilities in Mercantile and Business
Occupancies Serving Customers" is deleted.
(o) Section 413.6 of the U.P.C. entitled "Food Service Establishments" is deleted.
(p) Section 415.1 of the U.P.C. is amended to read as follows:
"A removable panel of sufficient size shall be provided to access the pump, but
in case less than a fourteen (14) inch by fourteen (14) inch opening with at least eighteen (18)
inches clear space in front of the access opening."
(q) Table 4 -1 of the U.P.C. entitled "Minimum Plumbing Facilities" is amended to
read as follows:
"Each building shall be provided with sanitary facilities, including provisions for
handicap accessibility in accordance with Chapter 11 of the [1997 Uniform]
2003 International Building Code and the [1996] 1998 ICC / ANSI A117.1
Accessible and Usable Buildings and Facilities Standards.
"The total occupant load shall be determined by using Table 10 -A "Occupant
Load Factor" of the [1997 Uniform] 2003 International Building Code and is
assumed to be based on fifty percent (50 %) male and fifty percent (50 %)
female.
"EXCEPTION: Where circumstances dictate a different ratio is needed, the
adjustment shall be approved by the Building Official. [See the attached Table
4 -1 as amended.]"
(r) Section 601.0 of the U.P.C. entitled "Running Water Required" is amended by
the addition of a new Section to read as follows:
"Section 601.4 In dwellings and buildings intended for human
occupancy, hot water shall be supplied to all plumbing fixtures and
equipment used for bathing, washing, culinary purposes, cleaning of
laundry or building maintenance."
(s) Section 604.1 of the U.P.C. is amended by the addition of the following
exception to read as follows:
(t)
"EXCEPTION: All new or replaced water service piping [less] fewer
than two (2) inches (51 mm) from the main to the meter shall be no
lighter than Type L Copper. All service piping two (2) inches 51 mm) or
larger shall be Type K Copper, Class 50 or Ductile Iron, Class 150
Asbestos Cement, or PVC American Water Works association
approved pressure pipe or other approved material. Water service
piping shall be installed to a minimum of forty -eight (48) inches (2119.2
mm) depth from the top of the pipe."
(t) Section 605.3 of the U.P.C., the first sentence is amended to read as follows:
"A fullway valve controlling all outlets shall be installed inside a building
or structure on the water service line in a readily accessible area."
(u) Section 707.10 of the U.P.C. is amended to read as follows:
"Each cleanout in piping two (2) inches (51 mm) or less in size shall be
so installed so there is a clearance of not less than twelve (12) inches
(305 mm) in front of the cleanout. Cleanouts in piping larger than two
(2) inches (51 mm) shall have a clearance of not less than eighteen
(18) inches (457 mm) in front of the cleanout." [ Cleanouts in underfloor
piping shall be extended to or above the finished floor or shall be
extended outside the building.]
(v) Section 713.0 of the U.P.C. entitled "Building Sewers" is amended by the
addition of a new Section to read as follows:
"Section 713.7 "Private Sewer (Mains)" as defined in Chapter 2 of this
Code, connecting to a public sewer system shall be installed according
to the specifications and requirements of the City Department of Public
Works. Plans and permits shall be as required by Chapter 1 of the
U.P.C. Private sewer inspections shall be made by the City
Department of Public Works or the Pueblo Regional Building
Department."
(w) [Section 603 of the U.P.C. entitled "Cross- Connection Control" is amended by
the following addition:
"All new or remodeled public buildings shall have a reduced pressure -type
backflow preventer installed on the water service supplying such buildings or
any portion thereof. "]
Subsection 408.6 of the U.P.C. entitled "Setting' is amended by the addition a
paragraph to read as follows:
Where more than one (1) water closet or water closets and urinals are installed
in a room, they shall be separated by an approved partition wall. Urinals set
next to each other or another fixture shall have an approved splash auard.
(x) Section 412.0 of the U.P.C. entitled " Floor Drains and Shower Stalls" is
amended by the addition of a new subsection 412.2.4 to read as follows:
412.2.4 Within three (3) feet where a hot water heating appliance or any
condensing equipment are located.

Table 4 -1 Footnote 3 of the U.P.C. is amended to read as follows:
3. Drinking fountains, mop sinks or service sinks shall not be installed in
restrooms. Service sinks shall be reauired on each floor where toilet facilities are reauired.
(z) Section 603.0 of the U.P.C. entitled "Cross- Connection Control" is amended
the followina addition:
"All new or remodeled public buildings shall have a reduced pressure -type
backflow preventer installed on the water service supplying such buildings or
any portion thereof."

floor /ceiling assemblies, roof /ceiling assemblies or shaft enclosures shall be
protected in accordance with the requirements of the 2003 International
Building Code, Chapter 6 and this Chapter.
Section 3, Chapter 4, Title IV of the Pueblo Municipal Code is amended to read as
4 -4 -3: AMENDMENTS TO MINOR CODES:
(a) The [1997] 2003 Edition of the Uniform Swimming Pool, Spa and Hot Tub
Code (U.S.P.S.P.H.T.C.) is amended as follows:
(1) Section 104.0 of the U.S.P.S.P.H.T.C. entitled "Administrative
Authority" is amended to read as follows:
"Administration and enforcement of this Code and all related codes are
delegated to the Pueblo Regional Building Department."
(2) Section 106.0 of the U.S.P.S.P.H.T.C. entitled "Violation and Penalties"
is amended to read as follows:
"Any person, firm or corporation violating any of the provisions of this Code,
upon conviction shall be punished as provided in Section 4 -4 -9 of the [1971
Code of Ordinances of the City of] Pueblo Municipal Code The application
of any such penalty shall not be held to prevent the enforced removal of
prohibited conditions."
(3) Section 110.0 of the U.S.P.S.P.H.T.C. entitled "Fees" is amended to
read as follows:
"Fees shall be as set in the fee schedule adopted by the City Council."
(4) Chapter 4 of the U.S.P.S.P.H.T.C. entitled "Water Heaters and Vents"
is deleted.
(5) Chapter 5 of the U.S. P.S. P. H.T.C. entitled "Fuel Gas Piping" is deleted.
(b) The [1997] 2000 edition of the Uniform Solar Energy Code (U.S.E.C.) is
amended as follows:
(1) Section 104.0 of the U.S.E.C. entitled "Administrative Authority" is
amended to read as follows:
"Administration and enforcement of this Code and all related codes are dele-
gated to the Pueblo Regional Building Department."
(2) Section 106.0 of the U.S.E.C. entitled "Violation and Penalties," the first
sentence is amended to read as follows:
"Any person, firm or corporation violating any of the provisions of this Code,
upon conviction shall be punished as provided in Section 4 -4 -9 of the [1971
Code of Ordinances of the City of] Pueblo Municipal Code The application of
any such penalty shall not be held to prevent the enforced removal of prohibited
conditions."
(3) Section 109.0 of the U.S.E.C. entitled "Cost of Permit" is amended to read
as follows:
"Fees shall be as set in the fee schedule adopted by the City Council."
(c) The [1995] 2002 edition of Standard 24- National Fire Protection Association
(N.F.P.A.) is amended as follows:
Section 1 -3 of the N.F.P.A. entitled "Definitions" is amended to read as follows:
"Authority Having Jurisdiction" shall mean administration and enforcement of this
Code and all related codes are delegated to the Pueblo Regional Building
Department."

Section 4, Chapter 4, Title IV of the Pueblo Municipal Code is amended to read as
follows:
4 -4 -4 Interpretation of the Uniform Plumbing Code
Wherever in the Uniform Plumbing Code it is provided that anything must be done to the
approval of or subject to the direction of the [administrative] authority having jurisdiction this
shall be construed to give such officer only the discretion to determine whether the rules and
standards established by the Uniform Plumbing Code have been complied with; and no such
provision shall be construed as giving any officer discretionary powers as to what such
regulations or standards shall be, or power to require conditions not prescribed by the
Uniform Plumbing Code or to enforce the provisions of the Uniform Plumbing Code in an
arbitrary or discriminatory manner.

Section 6, Chapter 4, Title IV of the Pueblo Municipal Code is amended to read as
4 -4 -6. Garbage disposal units
(a) All new residences and buildings which are designed, equipped and used for
storing or sheltering food or food stuffs for human consumption, including fruits, vegetables
and meats, which are to be sold either at retail at stores, clubs, hotels, restaurants, schools or
other food establishments or at wholesale, or which are prepared at food manufacturing or
processing plants, including slaughter houses, whether such places of business are licensed
under the provisions of any ordinance of the City, or not, and all buildings where foods for
human consumption are prepared, sold, handled, stored or served in any manner
whatsoever, and all existing buildings and residences so designed, equipped and used, when
substantially remodeled or altered in those facilities wherein such foodstuffs are processed,
prepared, sold, handled, stored or served, and all residences and all buildings where foods for
human consumption are prepared, sold, handled, stored or served in any manner
whatsoever, which shall hereafter be newly connected to the sewer system of the City, shall
be equipped with an appropriate type of food -waste grinder, or garbage disposal unit in good
operating condition, properly connected to the kitchen sink or house drain, which grinder and
connections shall be of sufficient size to grind all garbage and food processing wastes
produced in such building, and shall be suitably located so as to discharge such ground
material by flushing it with water through the drain pipes into the sewer.
(b) A food -waste grinder or garbage disposal unit is any device connected with the
City sewerage system which reduces garbage or food waste to smaller units by grinding,
pulverizing, screening or other methods suitable for passage in a sewerage system.
[ (c) Prior to the installation, reinstallation or replacement of a food -waste grinder or
garbage disposal unit, permits must be obtained by the plumber or contractor in accordance
with the regulations as set forth in this Code and secondary codes adopted thereby. The
regulations concerning installation as provided by this Code shall be followed, the purpose of
this Section being to further define certain features of proper installation incident to the type of
unit being installed. Installation of a food -waste grinder or garbage disposal unit must be
made by a licensed plumber or the owner as set forth in this Code. ]
[ (d) Any kitchen sink in any private dwelling equipped with a food -waste grinder or
garbage disposal unit shall have a minimum two -inch waste line. ]
[ (e) All food -waste grinders or garbage disposal units installed in private dwelling
units shall each discharge through a trap of not less than one and one -half (1 inches in
size. In two - compartment sinks where one (1) compartment is equipped with a food -waste
grinder or garbage disposal unit, both compartments may discharge through a single trap of
not less than one and one -half (1 inches.]
[ (f) All kitchen sinks in any private dwelling shall be vented, and if back vented,
such back vent shall be so located that the developed length (i.e. the developed length of a
line of pipe is its length along the center line of the pipe and fittings) of the vent from the trap
to the stack fitting is not more than five (5) feet. If the developed length exceeds five (5) feet,
a separate vent in conformance with the existing Plumbing Code shall be required.]
[ (g) All food -waste grinders or garbage disposal units may be connected and
trapped separately from any other fixture or compartment. Units may have either automatic
or hand - operated water supply control.]
[ (h) No food -waste grinder or disposal unit shall be connected through a grease
interceptor.]
[ (i) Commercial type food - grinders or garbage disposal units shall be provided with
not less than a two -inch waste line. Each waste shall be trapped and vented as provided in
other Sections of this Article.]
[ Q) All food -waste grinders or garbage disposal units shall conform to the following

The granulation characteristics as stated by the manufacturer must be filed and accepted
in accordance with this Section by the Plumbing Inspector prior to the installation of any food -
waste grinder or garbage disposal unit of that particular manufacturer.]
[ (k) All food -waste grinder or garbage disposal units shall be required to have a
water outlet so arranged that a continuous flow of cold water can be provided at all times
when said unit is in operation. The source of water to the unit shall be such that a positive
"Air Gap" exists between the unit and the source of water supply.]
SECTION 6.

Section 9, Chapter 4, Title IV of the Pueblo Municipal Code is amended to read as
4 -4 -9. Offenses; criminal penalties; permit revocation; other enforcement.
(a) It shall be unlawful and a Class 1 Municipal Offense for any person to knowingly
violate, disobey, omit, neglect, refuse or fail to comply with or resist the enforcement of
any provision of this Chapter or of the Uniform Plumbing Code, and upon conviction
thereof, the punishment therefor shall be a fine of not more than three hundred dollars
($300.00) or imprisonment for not more than ninety (90) days, or both such fine and
imprisonment.
(b) It shall be unlawful and a Class 1 Municipal Offense for any person to refuse or fail to
timely comply with an order issued by the Building Official or other designated
plumbing inspector pursuant to the provisions of this Chapter or the Uniform Plumbing
Code, and upon conviction thereof, the punishment therefor shall be a fine of not more
than three hundred dollars ($300.00), or imprisonment for not more than ninety (90)
days or both such fine and imprisonment.
(c) It shall be unlawful and a Class 1 Municipal Offense for any person to knowingly make
any false statement, representation or certification in any application, record, report,
plan or other document filed or required to be maintained pursuant to any requirement
of this Chapter or the Uniform Plumbing Code, and upon conviction thereof, the
punishment therefor shall be a fine of not more than three hundred dollars ($300.00),
or imprisonment for not more than ninety (90) days or both such fine and
imprisonment.
(d) Any permit issued pursuant to the provisions of this Chapter or the Uniform Plumbing
Code may be suspended, terminated or revoked by the Building Official for (1) any of
the reasons stated in Subsection 103.3.5 of the Uniform Plumbing Code, or (2) any
material violation of the terms of said permit or requirements applicable thereto.
(e) In the event any owner or occupant of premises within the City shall refuse entry to the
Building Official or any plumbing inspector, or if any premises are locked and the
Building Official or any plumbing inspector has been unable to obtain permission of
the owner or occupant to enter, The Pueblo Municipal Court is authorized to issue a
search or inspection warrant authorizing such entry in accordance with the procedures
set forth in the Colorado Municipal Court Rules of Procedure
(f) In the event any owner or occupant of premises within the City, or any licensed con-
tractor or any permittee, shall fail or refuse to comply with any provision of this
Chapter, the U.P.C. or any license or permit issued thereunder, the City may initiate
an action for injunctive relief in any court of competent jurisdiction to compel
compliance with this Chapter or the U.P.C., license or permit.
(g) The enforcement remedies in this Section are expressly declared to be cumulative,
and the exercise of any one (1) or more of them is not dependent upon the exercise of
any other remedy, nor does the exercise of any one (1) or more of them constitute any
bar or limitation to the exercise of any other.
The following Table 4 -1 and all footnotes are hereby deleted and Table 4 -1 set forth in the
Uniform Plumbing Code, 2003 Edition, shall control except as otherwise amended herein. [

MINIMUM PLUMBING FACILITIES'
Each building shall be provided with sanitary facilities, including provisions for handicap accessibility in accordance with
Chapter 11 of the 1997 Uniform Building Code and the 1996 ANSI A117.1 Accessible and Usable Buildings and Facilities
Standard.
The total occupant load shall be determined by using Table 10 -A (Occupant Load Factor) of the 1997 Uniform Building
Code and is assumed to be based on fifty percent (50 %) male and fifty percent (50 %) female.
EXCEPTION: Where circumstances dictate a different ratio is needed the adjustment shall be approved by the Building

materials, provide one (1) lavatory for each five (5) persons.
8 Twenty -four (24) lineal inches (609.67mm) of wash sink or eighteen (18) inches (457.2mm)
of circular basin, when provided with water outlets for such space, shall be considered equivalent
to one (1) lavatory.
9 Laundry trays, one (1) for each fifty (50) persons. Slop sinks, one (1) for each one
hundred (100) persons.
10 General: In applying this schedule of facilities, consideration must be given to the
accessibility of the fixtures. Conformity purely on a numerical basis may not result in an installation
suited to the needs of the individual establishment. Example, schools should be provided with
toilet facilities on each floor having classrooms.
a. Surrounding materials. Wall and floor space to a point two (2) feet (0.6m) in front of urinal
tip and four (4) feet (1.2m) above the floor and at least two (2) feet (0.6m) to each side of
the urinal shall be lined with non - absorbent material.
b. Trough urinals are prohibited.
11 A restaurant is defined as a business which sells food to be consumed on the premises.
a. The number of occupants for a drive -in restaurant or drive -in theater shall be
considered as equal to twice the number of parking stalls.
b. Employee toilet facilities are not to be included in the above restaurant
requirements. Hand washing facilities must be available in the kitchen for employees.
C. A restaurant with less than sixteen (16) inside seats and no outside seats, may have
only one (1) restroom to be used by the public and employees.
d. A restaurant with no seating inside and less than sixteen (16) seats outside, may
have only one (1) restroom to be used by the public and employees.
e. Other than the above exceptions, occupant loads shall include all inside and outside
seating for calculating requirements or by Table 10 -A of the 1997 UBC.
12 Where food is consumed indoors, water stations may be substituted for drinking fountains.
Offices or similar public buildings for use by more than six (6) persons shall have one (1) drinking
fountain for the first one hundred -fifty (150) persons and one (1) additional fountain for each three
hundred (300) persons.
13 There shall be a minimum of one (1) drinking fountain per occupied floor in schools,
theaters, auditoriums, dormitories, offices or public buildings.
14 The total number of water closets for females shall be at least equal to the total number of
water closets and urinals required for males.
15 For temporary construction facilities, one (1) water closet and one (1) urinal for each thirty
(30) persons shall be provided for each sex.
16 A single restroom may be provided for both sexes, and service sinks may be eliminated for
the following:
a. Retail occupancies of two thousand (2,000) square feet or less and have no food
service and usable by both the public and employees.
b. Offices, medical and dental clinics of one thousand (1,000) square feet or less and
usable by both the public and employees.
17 Where more than one (1) water closet or water closets and urinals are installed in a room
they shall be separated by an approved partition wall. Urinals set next to each other or another
fixture shall have an approved splash guard.
18 Does not apply to motel, hotel, condominium, apartment house or other limited access
pools, provided the use of the pool is restricted to bona fide occupants and the guests of these
buildings and provided the pool is within three hundred (300) feet, by a normal pedestrian route, of
the individual's residence or quarters,]
SECTION 7_
The purpose of the Uniform Plumbing Code is to safeguard the public health, safety,
property, and welfare by regulating and controlling the design, construction, quality of materials,
use, occupancy, location, alteration, maintenance and repair of all buildings and structures within
the City of Pueblo.
SECTION 8_
A public hearing on the adoption by reference of the said Uniform Plumbing Code, 2003
Edition, and all minor (related) codes listed in the title of this Ordinance, shall be held in the Council
Chambers, City Hall, Pueblo, Colorado, at 7:00 p.m. on September 13, 2004, and the City Clerk is
directed to publish notice of such public hearing in the manner and style and pursuant to the
schedule for such publication prescribed in Section 31 -16 -203, Colorado Revised Statutes.
SECTION 9.
Nonliability. The adoption of this ordinance and of the Uniform Plumbing Code shall not
create any duty to any person, firm, corporation, or other entity with regard to the enforcement or
nonenforcement of this ordinance or said code. No person, firm, corporation, or other entity shall
have any private right of action, claim or civil liability remedy against the City of Pueblo or the
Pueblo Regional Building Department, or their officers, employees or agents, for any damage
arising out of or in any way connected with the adoption, enforcement, or nonenforcement of this
ordinance or said code. Nothing in this ordinance or in said code shall be construed to create any
liability, or to waive any of the immunities, limitations on liability, or other provisions of the
governmental Immunity Act, Section 24 -10 -101 et seq., C.R.S., or to waive any immunities or
limitations on liability otherwise available to the City of Pueblo or the Pueblo Regional Building
Department, or their officers, employees or agents.
SECTION 10.
If any part, section, subsection, sentence, clause or phrase of this Ordinance, the Uniform
Plumbing Code or the minor codes adopted hereby is for any reason held to be invalid, such
decision shall neither affect the validity of the remaining portions of this Ordinance, the Uniform
Plumbing Code or the minor codes.
SECTION 11.
This Ordinance shall be come effective immediately upon final passage and approval.
