AN ORDINANCE APPROPRIATING $128,000 OF THE PROCEEDS FROM THE SALE OF HARP
LOTS FOR THE RIVERWALK CAFE AND SITE PREPARATION ON LOT #1
WHEREAS, a pad site on the HARP has been sold, and
WHEREAS, these funds are restricted to use in the improvement and maintenance of the
HARP facility, and
WHEREAS, the City Council desires to see improvement in the availability of food service
accommodations along the Riverwalk, and to do so site preparation on Lot #1, now therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that
SECTION 1 _
Funds in the amount of $128,000 shall be appropriated from the sale of lots account with
$118,000 to be used for the construction of a Riverwalk Cafe and $10,000 for site preparation on
Lot #1.
SECTION 2_
The HARP Authority will procure and administer the construction of the Riverwalk Cafe
Project in full cooperation with the appropriate City departments. In the event the design or
construction costs of the project require a change, such revisions are subject to prior approval of
the City Council. The HARP Authority will utilize the contracting procedures provided for in the
HARP Intergovernmental Agreement (IGA). Such contracting procedures do not preclude the
HARP Authority from securing in -kind and cash contributions through the HARP Foundation to
procure the products and services necessary to complete the Riverwalk Cafe Project. City
payments shall be made upon completion of work and presentation of detailed invoices. All project
costs shall be tracked, and upon completion a project cost summary including In -kind services
values reported to the City Finance Department.

Should lot sale funds be used to for a construction projects along the Riverwalk
channel?
RECOMMENDATION
Approval of ordinance
BACKGROUND
Lot #1 on the HARP was recently sold. Per the Intergovernmental Agreement
creating the HARP Authority, these proceeds must be used for capital
improvements or maintenance of the City's HARP facility. The HARP authority
will presented City Council with a plan to construct an eating area and food
service building, known as the Riverwalk Cafe. The HARP Authority also is
requesting that funds from this sale be used to pay for the site preparation costs
on Lot #1. With this ordinance, City Council will consider funding these projects
with proceeds from the recent lot sale.
FINANCIAL IMPACT
This Ordinance appropriates $128,000 of the lot sale proceeds for these projects.
