HomeMy WebLinkAbout07186ORDINANCE NO. 7186 AN ORDINANCE APPROVING MODIFICATIONS OF THE URBAN RENEWAL PLAN FOR THE PUEBLO EXPANDED URBAN RENEWAL PROJECT AND FINDING THAT SUCH MODIFICATIONS ARE MINOR MODIFICATIONS OF THE URBAN RENEWAL PLAN WHEREAS, on March 22, 2004, by Ordinance No. 7113, the City Council approved the Urban Renewal Plan for the Pueblo Expanded Urban Renewal Project (Expanded Plan); and WHEREAS, the Expanded Plan was and is intended to be an amendment to and an enlargement of the Urban Renewal Plan for the Amended Phase One Urban Renewal Project for Downtown Pueblo (Phase One Plan); and WHEREAS, the Expanded Plan was and is intended to implement redevelopment of the entire area circumscribed by the boundaries described in the Expanded Plan, including the area covered by the Phase One Plan; and WHEREAS, Section 31 -25- 107(3), C.R.S., provides that the City Council may modify the Expanded Plan and shall make a determination whether or not any such modifications will substantially change the Expanded Plan in land area, land use, design, building requirements, timing, or procedure; and WHEREAS, the City Council has determined that the modifications listed in Section 1, below, are minor modifications to the Expanded Plan and in furtherance of the goals and objectives of such Expanded Plan. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The following minor modifications to the Expanded Plan are hereby approved and adopted. a. The following words are deleted from the second and third lines from the end of the legal description on page 2 of the Expanded Plan: "...., excluding the Amended Phase One Urban Renewal Project for Downtown Pueblo...." b. The fourth paragraph of "A. Project Financing under the title "Plan Phasing and Financing Framework" on page 27 of the Expanded Plan is amended by adding the following after the first sentence thereof: "Unless extended by statute, the period of the property tax and sales tax allocation presently applicable to the area included in the Urban Renewal Plan for the Amended Phase One Urban Renewal Project for Downtown Pueblo shall be that mandated by the provisions of Section 31 -25- 107(9)(x), C.R.S., and is not affected by the following language, which applies to the rest of the Urban Renewal Area." C. The provisions of "A. Project Financing under the title "Plan Phasing and Financing Framework" are further amended by deleting the following language wherever it appears on pages 27 and 28 of the Expanded Plan: "...., excluding the Amended Phase One Urban Renewal Project for Downtown Pueblo,..." SECTION 2. The City Council finds that the modifications set forth in Section 1, above, are minor modifications that do not substantially change the existing Expanded Plan in land area, land use, design, building requirements, timing, or procedure. SECTION 3. This Ordinance shall become effective upon final passage and approval. Approve the Ordinance. CZT�3�• The Urban Renewal Plan for the Pueblo Expanded Urban Renewal Project ( "Expanded Plan ") was approved by City Council on March 22, 2004 (Ordinance No. 7113). The Expanded Plan excluded from its boundaries the Phase One Project area. Since the Expanded Plan is an amendment and expansion of the Phase One Project Plan, the Phase One Project area should be included in the boundaries of the Expanded Plan. The Planning Commission at the Thursday, July 29, 2004 Special Meeting unanimously approved the modification. None.
