HomeMy WebLinkAbout07184ORDINANCE NO. 7184 AN ORDINANCE SUBMITTING TO THE REGISTERED ELECTORS OF THE CITY OF PUEBLO, COLORADO AT THE SPECIAL MUNICIPAL ELECTION TO BE HELD ON NOVEMBER 2, 2004 A QUESTION RELATING TO COLLECTING, RETAINING AND EXPENDING $17,000,000 IN THE AGGREGATE ANTICIPATED TO BE RECEIVED FROM XCEL ENERGY, INC. AFTER ANNEXATION OF ITS FACILITIES TO THE CITY OF PUEBLO TO FINANCE THE ACQUISITION, CONSTRUCTION AND EQUIPPING OF A BUILDING FOR THE POLICE DEPARTMENT, MUNICIPAL COURT AND RELATED FUNCTIONS, TWO FIRE STATIONS, AND SATELLITE POLICE FACILITIES AS DETERMINED BY THE CITY COUNCIL WHEREAS, it is anticipated after annexation of its facilities to the City of Pueblo, Xcel Energy, Inc. will pay to the City at least $17,000,000 in new revenues; and WHEREAS, it would be in the best interest of the City and its citizens and would be in furtherance of the public health, safety and welfare of the City that the $17,000,000 be collected, retained and expended to finance the acquisition, construction and equipping of a building for the police department, municipal court and related functions, two fire stations, and satellite police facilities as determined by the City Council; and WHEREAS, the use of such funds for these purposes would require voter - approved revenue changes pursuant to Section 20, Article X of the Colorado Constitution. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1 The question of collecting, retaining and expending $17,000,000 in the aggregate in new revenues to be received from Xcel Energy, Inc. after annexation of its facilities to the City during fiscal year 2005 and subsequent years to finance the acquisition, construction and equipping of a building for the police department, municipal court and related functions, two fire stations, and satellite police facilities as determined by the City Council shall be submitted to a vote of the registered electors of the City of Pueblo at the special municipal election to be held November 2, 2004. The ballot title (submission clause and title) therefore shall be as follows: Question No. (authorizing $17,000,000 to be received from Xcel Energy, Inc. to be used for a building for the Police Department, Municipal Court and related functions, two fire stations, and satellite police facilities) WITHOUT CREATING ANY NEW TAX OR INCREASING ANY EXISTING TAXES, SHALL THE CITY OF PUEBLO BE AUTHORIZED TO COLLECT, RETAIN AND EXPEND $17,000,000 IN THE AGGREGATE OF NEW REVENUES RECEIVED OR COLLECTED DURING FISCAL YEAR 2005 AND SUBSEQUENT YEARS FROM XCEL ENERGY, INC. AFTER ANNEXATION OF ITS FACILITIES TO THE CITY TO FINANCE THE ACQUISITION, CONSTRUCTION AND EQUIPPING OF A BUILDING FOR THE POLICE DEPARTMENT, MUNICIPAL COURT AND RELATED FUNCTIONS, TWO FIRE STATIONS, AND SATELLITE POLICE FACILITIES AS DETERMINED BY THE CITY COUNCIL, WITHOUT LIMITATION OR CONDITION AS A VOTER - APPROVED REVENUE CHANGE AND AN EXEMPTION TO THE LIMITS WHICH OTHERWISE APPLY UNDER SECTION 20, ARTICLE X OF THE COLORADO CONSTITUTION OR ANY OTHER LAW? YES NO SECTION 2 The officers of the City are authorized and directed to take all action necessary, appropriate or required to effectuate the provisions of this Ordinance. RECOMMENDATION None. BACKGROUND It is anticipated that $17 million in new revenues will be collected and received from Xcel Energy during the fiscal year 4005 and subsequent years after annexation of its facilities to the City. The ordinance submits to a vote of the people the ballot question authorizing the City to retain and spend the $17 million for acquisition, construction and equipping of a building for the police department, municipal court and related functions, two fire stations, and satellite police facilities.
