ORDINANCE NO. 7178
AN ORDINANCE VACATING AN EASEMENT LOCATED WITHIN LOT 2
EAGLECROSS SUBDIVISION SIXTH FILING WHICH IS LOCATED NORTHWEST OF
THE INTERSECTION OF EAGLERIDGE CIRCLE AND EAGLERIDGE BOULEVARD.
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that:
SECTION 1.
The easement located within Lot 2, Eaglecross Subdivision Sixth Filing and more
particularly described as follows:
A portion of that utility easement located within Lot 2, Eaglecross Subdivision Sixth
Filing filed for record May 2, 2003 at Reception No. 1499456 in the records of the
Pueblo County Clerk and Recorder being more particularly described as follows:
BEGINNING at the intersection of the east line of said Lot 2 and the north line of a 10
foot sidewalk and public utility easement filed for record March 16, 1995 in Book 2790
at Page 860 -865, from which the SE corner of said Lot 2, bears S 00 °12'43 "W a
distance of 10.00 feet; Thence N 89 °46'41 "W along said north line a distance of 20.00
feet; Thence N 00 °12'43 "E a distance of 20.00 feet; Thence S 89 °46'41 "E a distance of
20.00 feet to a point on said east line of Lot 2; Thence S 00 °12'43 "W along said east
line a distance of 20.00 feet to the POINT OF BEGINNING.
is hereby vacated.
SECTION 2.
This ordinance shall become effective immediately upon final passage and

AN ORDINANCE VACATING AN EASEMENT LOCATED WITHIN LOT 2,
EAGLECROSS SUBDIVISION SIXTH FILING WHICH IS LOCATED
NORTHWEST OF THE INTERSECTION OF EAGLERIDGE CIRCLE AND
EAGLERIDGE BOULEVARD.
ISSUE
Shall City Council approve the vacation of a 20' X 20' utility easement located
within Lot 2, Eaglecross Subdivision Sixth Filing?
RECOMMENDATION
The Planning and Zoning Commission voted 6 -0 at their regular meeting of June
9, 2004 to recommend approval.
BACKGROUND
The applicant is requesting the vacation of a 20' X 20' utility easement. Upon
final plat it was determined that this property was no longer required for an utility
easement. It is the recommendation of the Subdivision Review Committee
(SRC) that the vacation be approved.
FINANCIAL IMPACT
None
