AN ORDINANCE SUBMITTING TO A VOTE OF THE REGISTERED ELECTORS OF THE CITY OF
PUEBLO AT THE SPECIAL MUNICIPAL ELECTION TO BE HELD ON NOVEMBER 2, 2004, A
PROPOSED AMENDMENT TO ARTICLE 8 OF THE CHARTER OF THE CITY OF PUEBLO
ESTABLISHING EMPLOYEE RESIDENCY REQUIREMENTS
WHEREAS, based upon the records of the Department of Human Resources, 300 full -time
employees out of 673 permanent full -time employees of the City, or 45% thereof, currently reside
outside the jurisdictional boundaries of the City; and
WHEREAS, 78 employees of the Fire Department out of 141 permanent full -time employees,
or 55% thereof, currently reside outside the jurisdictional boundaries of the City; and
WHEREAS, establishing residence requirements for employees hired on or after January 1,
2005 would enhance the future growth and economic development of the City and be advantageous
to its citizen's. NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: (brackets indicate matter

SECTION 1
The City Council does hereby find and determine that:
(a) employee residency requirements will increase the investment of City tax dollars within
the City in that City employees living in the City will pay City real property and sales tax; and,
(b) requiring City employees to reside within the City would make such employees more
readily available in the event of a civic emergency; and,
(c) requiring City employees to reside within the City will tend to instill a sense of pride in
their work by guaranteeing that the employees have a stake in the common enterprise of City
government and thereby assist them to be more attentive, compassionate and diligent in the way they
provide municipal services to City residents; and,
(d) employee residency requirements will make available increased employment
opportunities for residents of the City thereby promoting ethnic balance in the City workforce, and
reducing unemployment rates within the City; and,
(e) employee residency requirements will tend to reduce tardiness and absenteeism
among City employees.
SECTION 2
There is hereby submitted to a vote of the registered electors of the City of Pueblo at the
special municipal election to be held November 2, 2004 an amendment to Article 8 of the Charter
of the City of Pueblo by adding the following new Section 8 -16 thereto to read as follows:
Section 8 -16. Residency Requirements - Notwithstanding any other provision in this
Charter, City ordinances, or collective bargaining agreements, all employees in the
classified and unclassified services of the City who are employed or appointed on or after
January 1, 2005 shall, as a condition of their employment, and as a condition of their
continued employment, reside within the corporate boundaries of the City within six (6)
months after their employment or appointment, except part -time employees who shall
reside in the City at the time of their employment or appointment. "Reside" means to
establish, maintain and occupy a dwelling within the corporate boundaries of the City on a
continuous and permanent basis. This section shall not be applicable to employees in the
classified and unclassified services of the City who were appointed or employed prior to
January 1, 2005 and who remain as City employees. Any employee who violates any
provision or requirement of this section shall be terminated and his or her position with the
Citv shall be declared vacant.
SECTION 3
The ballot title (submission clause and title) for the proposed Charter amendment set forth
in Section 1 hereof is hereby fixed and adopted as follows:

SECTION 4
The officials of the City are authorized and directed to take all actions necessary,
appropriate or required to effectuate the provisions of this Ordinance. The City Clerk is directed
to publish notice of election upon the Charter amendment in conformity with the provisions of
Section 31 -2- 210(4), C.R.S.
SECTION 5
This Ordinance shall become effective upon final passage and approval, provided,
however, that the Charter amendment set forth in Section 1 hereof shall become effective only
upon the affirmative vote of a majority of the registered electors voting thereon at the special
municipal election held on November 2, 2004.

ISSUE
Should the City Council submit to a vote of the people residency requirements for
employees appointed or employed on or after January 1, 2005?
RECOMMENDATION
Submit the proposal to a vote of the people.
BACKGROUND
Pursuant to the attached Permanent City of Pueblo Employees, 300 full -time
employees out of 673 full -time employees of the City, or45% thereof, reside outside
the jurisdictional boundaries of the City. It would be in the best interest of the City
that employees hired on or after January 1, 2005 reside within the City. See
Section 1 of the Ordinance for justification of residency requirements.
FINANCIAL IMPACT
Increase City's revenue if employees reside in the City.
