HomeMy WebLinkAbout07135Reception 1591281 10/25/2004 ORDINANCE NO. 7135 AN ORDINANCE APPROVING EAGLE HEIGHTS FILING NO. 2 SUBDIVISION SPECIAL AREA PLAN WHEREAS, Eagle Heights Filing No. 2 Subdivision Special Area Plan has been submitted to the Planning and Zoning Commission for approval pursuant to Section 17- 4 -29 of the Pueblo Municipal Code, and WHEREAS, the Planning and Zoning Commission after a public hearing found and determined the objectives and requirements of said Section 17 -4 -29 can and will be met, and WHEREAS, the Planning and Zoning Commission has recommended the approval of Eagle Heights Filing No. 2 Subdivision Special Area Plan without conditions: NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The Eagle Heights Filing No. 2 Subdivision Special Area Plan being a special area plan of land described as follows: A portion of land located within the Northwest' /4 of the Northwest' /4 of Section 13, Township 20 South, Range 65 West, of the 6 th Principal Meridian, Pueblo County, State of Colorado, being more particularly described as: All of Eagle Heights, A Special Area Plan, according to the record plat thereof filed for record at Reception No. 1328022 of the Pueblo County records, Pueblo, Colorado. Said Parcel contains 4.85 Acres, more or less, is hereby approved. After considering the recommendation of the Planning and Zoning Commission, the City Council finds and determines that the Special Area Plan includes and provides for park and recreation facilities necessary to serve the proposed subdivision or development and the future residents thereof. SECTION 3. RECOMMENDATION The Planning Commission voted unanimously (6 -0) to recommend approval. BACKGROUND Eagle Heights Filing No. 2 Subdivision generally located on the northside of Pueblo, northeast of the intersection of Paseo Del Norte and Fortino Blvd. The applicant wishes to, develop the 4 acre parcel as a special area plan. The plan includes 15 single - family homes, private sewer, utilities, street system and recreational amenities. This application is submitted concurrently with Subdivision S- 04 -02, and vacation of all of the easements (V- 04 -02) lying within Eagle Heights Subdivision Special Area Plan, which were both approved unanimously. The applicant has complied with all of the items listed in the SCR memo dated January 28, 2004 and is in compliance with the conditions of approval made by the Planning and Zoning Commission on February 11, 2004 as confirmed in the memo from Joe Martellaro dated March 25, 2004.
