ORDINANCE NO. 7134
AN ORDINANCE VACATING EASEMENTS LYING
WITHIN EAGLE HEIGHTS SUBDIVISION SPECIAL AREA PLAN
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that:
SECTION 1.
The vacation of the drainage, public utility, private sanitary sewer, ingress /egress, and
parking easements lying within Eagle Heights, A Special Area Plan and more
particularly described as follows:
A PARCEL OF LAND LOCATED WITHIN THE NORTHWEST ONE - QUARTER OF
SECTION 13, TOWNSHIP 20 SOUTH, RANGE 65 WEST OF THE 6 PRINCIPAL
MERIDIAN, CITY AND COUNTY OF PUEBLO, BEING DESCRIBED AS ALL PUBLIC
UTILITY, DRAINAGE, INGRESS /EGRESS, PARKING AND PRIVATE SANITARY
SEWER EASEMENTS LYING WITHIN EAGLE HEIGHTS, A SPECIAL AREA PLAN,
AS RECORDED AT RECEPTION NO. 1328022, COUNTY OF PUEBLO RECORDS,
are hereby vacated.
SECTION 2.
This ordinance shall become effective immediately upon final passage and
approval.

TITLE
AN ORDINANCE VACATING EASEMENTS LYING WITHIN EAGLE HEIGHTS
SUBDIVISION SPECIAL AREA PLAN
ISSUE
Shall City Council approve the vacation of the drainage, public utility, private
sanitary sewer, ingress /egress, and parking easements?
RECOMMENDATION
The Planning and Zoning Commission voted 6 -0 at their regular meeting of
March 10, 2004 to recommend approval.
BACKGROUND
The applicant is requesting the vacation of all public utility, private sanitary
sewer, drainage, ingress /egress, and parking easements located within Eagle
Heights Subdivision Special Area Plan. The purpose of the vacation is to allow
the development of a new special area plan for a proposed new development of
the site. The approval of the plat of Eagle Heights Subdivision, Filing No. 2
dedicated new public utility, private sanitary sewer, drainage, ingress /egress, and
parking easements. Therefore, the existing easements are no longer needed
and need to be vacated. It is the recommendation of the Subdivision Review
Committee (SRC) that the vacation be approved.
