AN ORDINANCE APPROVING WITH CONDITIONS A MAJOR MODIFICATION TO THE
CERTIFICATE OF DESIGNATION FOR ADDITION OF NEW LIQUID WASTE AND SLUDGE
IMPOUNDMENTS TO THE PHASE III UNIT, PUEBLO SOUTHSIDE LANDFILL
WHEREAS, on June 22, 1992, Council adopted Resolution No. 6951 which ratified, approved
and authorized a separate Certificate of Designation for municipal solid waste landfill units identified
as Phase II and Phase III of the Pueblo Southside Landfill; and
WHEREAS, said Certificate of Designation for the Phase III Unit was effective and the facility
began operation prior to adoption of Ordinance 5996 of the City of Pueblo, passed and approved on
July 24, 1995; and
WHEREAS, on July 14, 1997, Council adopted Ordinance No. 6208 which approved with
conditions a major modification to said Certificate of Designation for the Phase III Unit, Pueblo
Southside Landfill, which modification had been requested by the operator, Zupan Enterprises, Inc.;
and
WHEREAS, Zupan Enterprises, Inc. has submitted a new Application for amendment of said
Certificate of Designation for the Phase III Unit, Pueblo Southside Landfill which seeks to add Liquid
Waste and Sludge Impoundments to the Phase III Unit (the "Application "); and
WHEREAS, the Application seeks changes to said Certificate of Designation which would
constitute a Major Modification to the COD as defined by Section 4- 12- 1(b)(5) of the Pueblo Municipal
Code and is therefore subject to the provisions of Ordinance 5996, as codified in Chapter 12 of Title
IV of the Pueblo Municipal Code and of Part 1 of Article 20 of Title 30, Colorado Revised Statutes;
and
WHEREAS, the Application has been reviewed by the Colorado Department of Public Health
and Environment and on November 13, 2003 was conditionally recommended for approval by the City
Council of Pueblo; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1
A public hearing to consider the adoption of this Ordinance approving with conditions a major
modification to the Certificate of Designation for the Phase III Unit, Pueblo Southside Landfill, as same
is described and identified in Council Resolution No. 6951, shall be held in the Council Chambers,
City Hall, 1 City Hall Place, Pueblo, Colorado, at 7:00 p.m. on the 26th day of April, 2004 The City
Clerk is directed to publish notice of such hearing pursuant to Section 30- 20- 104(3)(a), C.R.S., in a
newspaper having general circulation in the City at least ten (10) but not more than thirty (30) days
prior to the date of the hearing. In addition, the City Clerk is directed to post such notice in a
conspicuous location in City Hall and in at least one conspicuous location at the Phase III Unit of the
Pueblo Southside Landfill which is visible to the public. Posting shall be for not less than thirty days
before said public hearing and shall continue through the date of such hearing.
SECTION 2_
Upon consideration of the Application submitted by Zupan Enterprises, Inc. for amendment of
the Certificate of Designation for the Phase III Unit, Pueblo Southside Landfill, the report of the
Colorado Department of Public Health and Environment thereon, the City's applicable zoning and land
use restrictions, and all of the testimony and evidence submitted at the public hearing thereon, the
City Council finds and determines as follows:
1. The Application for amendment of the Certificate of Designation (hereinafter referred to
as "the Application ") submitted by Zupan Enterprises, Inc. (hereinafter "Applicant ") consists of all of
the following documents as component parts thereof:
A. Letter dated November 25, 2003 from Gerald W. Knudsen, P.E., Knudsen Engineering,
Inc. to Gina Dutcher, City Clerk.
B. Design and Operations Plan, Waste Impoundments Southside Landfill Pueblo, Colorado
prepared by Knudsen Engineering, Inc. dated June 2003 ( "Design and Operations Plan ").
C. Drawings of Site Plan, Plot Plan, Impoundment Cross Sections, Proposed Grading Plan,
Liquid Impoundment Liner System and Sludge Impoundment Liner System accompanying
the Design and Operations Plan.
D. Attachments A, B and C to Design and Operations Plan and Location and Vicinity Maps.
E. All documents and component parts thereof constituting the prior Application for
amendment of the Certificate of Designation approved by Ordinance No. 6208.
2. The Application seeks to add Liquid Waste and Sludge Impoundments to the Phase III
Unit of the Pueblo Southside Landfill, which is sometimes referred to as the Phase 3 Unit of the
Pueblo Southside Landfill. The expansion sought by Applicant constitutes a Major Modification to the
existing Certificate of Designation which was previously ratified, approved and authorized by Council
Resolution No. 6951 (hereinafter "the COD ") for said facility, as subsequently modified by Ordinance
No. 6208. The legal description of the Phase 3 Unit is contained in the Application. The Phase 3 Unit
is located within the City of Pueblo. The Phase 3 Unit is a separate and independent facility from the
Phase I -East Area and Phase I -West Area of the Pueblo Southside Landfill which are discrete
municipal solid waste landfill units which ceased receiving waste and were closed prior to October 8,
1993.
3. The Colorado Department of Public Health and Environmental (hereinafter "CDPHE ")
has reviewed the Application and submitted a letter report dated November 13, 2003 recommending
approval of the Major Modification subject to, i nter -alia Applicant's compliance with the conditions set
forth in said report, approval by the City of Pueblo, and imposition of any local conditions required by
the City.
4. The proposed amendment to the COD will not adversely affect surrounding property,
taking into consideration the types of processing to be used, surrounding property uses and values,
and wind and climatic conditions. The proposed amendment is consistent with the land use and
zoning ordinances of the City.
5. The proposed amendment to the COD will maintain the convenience and accessibility
of the solid wastes disposal site and facility to potential users.
6. Applicant is able to comply with the health standards and operating procedures
provided for in Part 1 of Article 20 of Title 30, Colorado Revised Statutes and applicable rules and
regulations of CDPHE.
7. The Pueblo City- County Health Department has recommended approval of the
Application.
8. A duly noticed public hearing has been held in accordance with Section 30 -20- 104(3)
and Council has considered all testimony provided at such hearing, including, without limitation,
testimony from governmental entities, persons residing within the City and persons residing within
three miles of the Phase 3 facility.
9. Approval of the Application will maintain or enhance competition in the Pueblo area for
solid waste disposal services.
10. Approval of the Application, subject to the conditions and requirements set forth in the
CDPHE November 13, 2003 letter report, is in the best interest of the public.
SECTION 3
Based upon the Council findings set forth in Section 2 of this Ordinance, Council orders as
follows
1. The Application for major modification of the Phase III Unit, as set forth in the
Application, subject to Applicant's acceptance and performance of, at Applicant's sole expense, the
conditions and requirements set forth in the CDPHE letter report dated November 13, 2003, a true
copy of which is attached hereto and incorporated herein by reference, be and is hereby approved as
a major modification to the Certificate of Designation for the Phase III Unit facility.
2. Application fees established by City are waived pursuant to the provisions of Section 4-
12-3(c) of the 1971 Code of Ordinances, as amended.
3. Except as modified by this major modification, the terms, conditions and requirements
applicable to the COD, as amended by prior approved modifications, shall remain in effect and
applicable to the Phase III Unit Facility.
4. Nothing in this Ordinance, or in any documents incorporated or referred to in this
Ordinance, is intended, nor shall it be construed, to adopt, require, or impose any new or additional
requirements upon any closed municipal solid waste landfill units, including without limitation, the
Phase I -West Area and Phase I -East Area of the Pueblo Southside Landfill.
SECTION 4
This Ordinance shall become effective immediately upon final passage and approval.

ISSUE
Should the City Council approve a modification to the Certificate of Designation for the
Pueblo Southside Landfill to allow for the addition of liquid waste impoundment
facilities.
RECOMMENDATION
Approval of this Ordinance.
BACKGROUND
Zupan Enterprises, Inc., the owner of Phases II and III of the Southside Landfill, has
submitted an application to add a liquid waste and sludge impoundment facility on its
property at the Southside Landfill. This facility will accept non - hazardous liquid wastes,
including car wash sludges and potable water treatment plant sludges. Copies of the
Design and Operation Plan and a site plan for the facility are attached.
The application has been reviewed and approved with conditions by the Colorado
Department of Public Health and Environment and by the Pueblo County Health
Department. See attached letters dated November 13, 2003, and January 20, 2004,
respectively.
If approved, construction of the facility is anticipated to begin in the spring of 2004 with
completion sometime in late summer.

1.0 INTRODUCTION
The owner and operator of Southside Landfill, Zupan Enterprises, Inc. (Zupan) has had
many requests to dispose of non - hazardous liquid waste. Current regulations and landfill
policies prohibits the acceptance of waste that does not exceed the Paint Filter test for
free liquids. It is suspected that a large quantity of non - hazardous liquid waste is being
disposed of improperly, and in many cases illegally. Zupan is proposing the construction
of waste impoundments that will accept free liquids and other material that have liquid
components in excess of the Paint Filter test criteria.
2.0 REGULATORY REQUIREMENTS AND DESIGN CRITERIA
The waste impoundments will be constructed and operated in accordance with Section 9
of the "Regulations Pertaining to Solid Waste Disposal Sites and Facilities (6 CCR 1007-
2), Waste Impoundments" (Regulations). The Regulations, which are administered by
the Colorado Department of Public Health and Environment (Department) identify three
classes of impoundments based on the potential of the site as an aquifer recharge area;
existing or future uses of any surface or ground water which could be impaired by
seepage from the impoundment; the constituents of the wastes, their toxicity, mobility
and persistence; and the geological and hydrologic characteristics of the site. The
owner /operator has chosen to construct and operate the system in accordance with the
most stringent Class I impoundment requirements.
In accordance with the design standards for a Class I impoundments, the system will
include the following:
• Double liner with a highly permeable collection layer between, and
• Sump and access piping to allow detection and collection of any leakage through
the upper liner.
In addition, the double liner system will be constructed over a 1 -foot thick compacted
shale bedding layer, and located over the 100 -foot thick Blue Hill Shale (Scott, 1969).
The low permeability Blue Hill Shale is currently used as a clay liner for the landfill
operation. The impoundments will be located in the shale borrow area.
In accordance with the Waste Impoundment General Design Standards (Section 9.5), the
system will include the following:
• A fixed clearly visible gauge to indicate the depth of waste to the nearest five
hundreds (0.05) of a foot,
• Embankments designed to minimize erosion and to withstand all forces from
impounded wastes with a minimum freeboard of two feet,
• Lockable sump access pipes, and
• Method of quickly and accurately determining the total volume of wastes in each
impoundment and the exposed surface area by correlation with the depth of
wastes.
3.0 WASTE ACCEPTANCE CRITERIA
The current landfill operation does not accept wastes that exceed the Paint Filter test for
free liquids, publicly operated treatment works (POTW) sludges with less than 20 percent
solids and other material with less than 40 percent solids. The waste impoundments will
be constructed for treatment and disposal of these materials. Typical waste streams that
will be included are:
• Potable water treatment plant residues,
• Oil/water separator sludges,
• Car wash sludges,
• Sand trap waste, and
• Other non - hazardous waste liquids.
Prior to acceptance at the waste impoundments, all waste must be carefully characterized.
The first step in the characterization consists of the preparation of a Special Waste
Disposal Application by the generator or the generator's authorized representative. A
copy of the application form is included as Attachment A. The waste impoundment
manager, or his designated representative will review these applications.
3.1 Special Waste Disposal Application
The application must be legibly completed, signed by legally responsible individual and
submitted to the facility for review. As indicated on the application form, the following
information shall be provided:
General Information: All generator information must be provided, including complete
name and address, appropriate contact, and telephone numbers. This information must
correspond to the site where the waste was generated.
General Material Description: Sufficient information must be given so the reviewer can
clearly understand the nature of the waste.
Waste Quantity and Frequency of Delivery: This information must be estimated as
accurately as possible.
Process Generating Waste: Sufficient detail must be given to determine whether the
waste is a listed hazardous waste. Listed hazardous wastes will not be accepted.
Physical Properties Chemical Properties. and Other: In order to complete these sections,
appropriate laboratory analysis must be performed to characterize the waste. The
laboratory analysis must be entered for the appropriate properties and constituents. The
laboratory reports must be attached to the application and must contain, at a minimum,
the results, analytical methods, chain of custody forms, and quality assurance data. A
sampling information form must be completed for all waste samples submitted for
laboratory analysis. This form must accompany the application.
A valid Material Safety Data Sheet (MSDS) may be satisfactory to describe the physical
and chemical properties of certain discarded solid wastes and chemicals. In some cases,
the MSDS may also provide disposal information.
Other Information: The delivery method must be indicated on the application. If a
generator is proposing to deliver wastes that exceed the acceptance criteria presented in
this plan, but are believed to be appropriate for disposal at the facility, the generator will
so indicate by checking the appropriate box. Specific, case -by -case approval by local and
state regulatory authorities will then be required.
Generator Certification: This section will be completed by the generator and certifies
that the information of the application is accurate and the special waste in not a hazardous
waste.
3.2 Evaluation of Waste Characteristics
The General Manager, or an authorized consultant retained for this purpose, will review
each application. The review process will be performed as follows:
1. The application will be inspected for completeness. All Applications must have clear
and legible information concerning the generator, the amount and type of waste, and
analysis results for applicable physical and chemical properties.
2. The general material description and process which generated the waste will be
compared to 40 CFR 261.31, 261.32, and 261.33 to determine if the waste is a listed
waste. Listed wastes could include nonspecific sources (F), specific sources (K), or
discarded commercial chemical products (Acute Toxic Chemicals list). Listed wastes are
hazardous and therefore will not be accepted.
3. The MSDS will be reviewed to determine if the waste exhibits any hazardous waste
characteristics.
4. The laboratory analysis will be reviewed and quality assurance data checked to verify
that the waste properties do not exhibit hazardous characteristics according to 40 CFR
261.20 through 261.24.
If the waste is deemed acceptable for disposal according to the process described in this
section, the reviewer will sign and date the application.
3.3 On -Site Waste Screening
As specified in Section 9.8 of the Regulations, on -site waste screening will be conducted
according to the following procedures:
• Each waste stream shall be tested at least annually by the operator to demonstrate
conformance with the original analyses by taking an unannounced grab sample

from trucks entering the facility and comparing the analysis for the original or
approved amended list of parameters. If any waste is found to differ significantly
from the original analysis, the Department shall be notified in writing within
fifteen working days.
• Each load of waste shall be registered with the following information entered on a
single receipt:
o Original analytical results or reference to those results
o Date and time
• Receiving impoundment identification
• Quantity
• Type of waste
• Location produced
• Owner and/or lessee where produced
o Hauler and truck number
o Driver's name and signature
• Individual load receipts shall be maintained for at least two years, with monthly
summaries for the life of the facility
4.0 PROCESS DESCRIPTION
The waste impoundment system will consist of several impoundments to provide
flexibility in operation and redundancy in case specific ponds need to be isolated or
drained for maintenance. The system also allows long -term customers the ability to have
their waste managed in dedicated units.
The impoundment layout is shown on Sheet 1. The initial construction will consist of
one sludge impoundment and two liquid impoundments. Four future liquid ponds are
shown on the sheet. Additional ponds may be added with approval of the City and the
Department. The site layout provides the option of routing liquids through the sludge
pond or discharging directly into the ponds.
Liquid will be transferred from one pond to the next using portable pumps. There is no
cross - connection piping. This method of liquid transfer requires that personnel be at the
site at all times when the transfer is occurring.
The liquid from the impoundments will be removed for dust control at the landfill.
Evaporation has been calculated using US Department of Agriculture Natural Resource
Conservation Service (NRCS) water balance models. The evaporation, precipitation and
the 25 -year, 24 -hour storm events are based on local weather data. The water balance
calculation sheets are included as Attachment B. Based on data from a Pueblo weather
station, the precipitation inflow would be 0.35 acre -feet, evaporation would be1.29 acre -
feet and allowable seepage (1 x 10 -6 cm/sec) would be 0.19 acre -feet. Net loss for each
liquid impoundment would be 1.47 acre -feet, or 480,000 gallons per year. Oil, grease or

other materials that may reduce evaporation will be removed with absorbent socks or
booms, or through the use of flocculants. The process flow diagram is as follows:

In addition to evaporation, waste treatment will occur in the impoundments through
natural processes, such as biological treatment, volatilization, ultra violet light
degradation and natural chemical decomposition. The type of mechanism will depend on
the constituents in the liquid.
4.1 Liquid Impoundments Details
Liquid impoundments will be used to evaporate and treat free liquids. The liner system
for the liquid impounds is shown in Figure 1 and Sheet 6.
4.2 Sludge Impoundment Details
Sludge impoundments will receive contaminated soil, sludges and other material with
high solids content. Since soil and other treated solids will be spread and removed with
light excavating equipment, the sludge impoundments will be constructed with one foot
of compacted road base to protect the GCL liners. An orange- colored plastic snow fence
will be placed in the middle of the road base to alert the operators that they have
excavated into the base material. The liner system for the sludge impounds is shown in
Figure 2 and Sheet 7.

5.0 LIQUIDS AND SOLIDS DISPOSAL
5.1 Liquids
Liquids from the impoundments will evaporate or be used for dust control. Liquids used
for dust control within the Certificate of Designation boundary will be tested and only
used if the concentration of constituents is below the level specified in the stormwater
discharge permit.

Liquid for offsite dust control or construction purposes will be required to meet the
limitations specified in the Rationale for Minimal Discharge, General Permit in Colorado,
Colorado Discharge Permit Number COG - 600000 published by the CDPHE Water
Quality Control Division (WQCD). The limitations that are applicable are in Section
E(a), "facilities discharging wastewater from washing the exteriors of trucks, cars,
airplanes..." Liquid will only be provided to offshe dust control or construction purposes
only if approval by the WQCD is not required if a CPDES permit for Minimal Discharge
is obtained. Maximum daily limitations for discharge are as follows:
• Total BTEX, 0.1 mg/l
• pH, 6.5 to 9.0 s.u.
• Oil and grease, 10 mg/1
5.2 Solids
Dewatered solids will be removed from the sludge impoundments and used at the landfill
as topsoil or daily cover. If the material has been impacted by petroleum hydrocarbons, a
chemical analysis will be conducted to determine if the material can be used at the
landfill or if further degradation time is required.
All solids disposed of in the landfill will meet the requirements of the landfill Special
Waste Acceptance and Disposal Plan. Those levels are:

6.0 SITE LAYOUT, DETAILS AND CONSTRUCTION
The site plan, plot plan, cross sections, grading plan, details and volume staging table are
shown on the attached plan sheets. The depth of the liquids will be monitored using
visual observation from gauge poles placed on the bottom of the ponds. The poles will
have markings in increments of 0.05 feet. The gauge poles will be placed in truck tires
filled with concrete as shown in the following figure.
The liners will be installed in accordance with the manufacturer's specifications.
Subbase construction will be in accordance with the Departments guidelines, which are
included as Attachment C. A construction QA/QC will be submitted to the Department
prior to the acceptance of waste. The report will be prepared by a Colorado Professional
Engineer and will contain the appropriate seal and signature.
6.1 Operation and Maintenance
Solids Removal
Sludge and saturated soils will be placed in the sludge impoundment. The facility has
been designed to allow dewatering with gravity. As shown on Sheets 2 and 4, a concrete
pad will be constructed to allow for equipment to access to remove the dewatered sludge.
A plastic snow fence will be installed in the road base to alert the operators that they have
excavated too far and must stop to prevent damage to the liners.
Contingency Plan
Multiple evaporation cells will be constructed in case a cell is taken out of service due to
excessive leakage or for maintenance. Liquid in the pond of concern will be pumped to
another pond until the repairs or maintenance is completed. The use of multiple,
redundant cells eliminates the need for offshe disposal options.
Mana e,��ment
The site will have a full time manager under employment or contract with Zupan
Enterprises, Inc. Initially, landfill staff will be available on as -need basis for monitoring
the loads and general operation, maintenance and inspection. When needed, dedicated
staff will assigned to the facility.
7.0 SITE ACCESS
Access to the site is restricted because the impoundments are located within the landfill
operations area. A full -time gatekeeper will monitors access to the impoundments. In
addition, a fence will be installed around the impoundments to restrict livestock and other
animals.
8.0 MONITORING OF IMPOUNDMENTS
8.1 Monthly Summaries
Monthly summaries for each impoundment shall contain the following:
• Total volume of each waste stream disposed or treated
• Waste stream identification(s)
8.2 Impoundment Contents
At least one sample of the contents of each impoundment shall be analyzed annually for
the original or amended list(s) of characteristic parameters for all waste streams placed in
the impoundment. If the impounded wastes are subject to stratification, a separate
sample shall be taken from representative levels, including settled sludge and oil or other
surface scum. Measurement of the thickness of each layer shall be performed as part of
this analysis.
8.3 Damage to Embankments or Liners
Records shall be maintained to fully document any damage and repairs to embankments
or liners, personal injury accidents, spills, detection of liquids in sumps, fires or
explosions. Written notification shall be submitted to the Department within fifteen
working days after discovery of such liner damage or other event which affect the
operation of the facility.
8.4 Leak Detection
Leak detection access ports shall be inspected weekly for presence of any liquids. If
liquids are found, samples shall be analyzed immediately, and thereafter, monthly
samples shall be analyzed for the original or approved amended list(s) of parameters for
all wastes in the impoundment.
8.5 Inspections
The operator will conduct a weekly general inspection with written documentation of the
condition of impoundment embankments and related piping or structures. The inspection
will include evidence of ground movement, cracks, erosion, leaks, rodent burrows,
vegetation growing on a liner soil cover, or other problems that may affect the integrity of
an impoundment.
8.6 Clay or Soil Liners
Clay or soil liners are currently not going to be used as the exposed liner material.
However, if used in the future in Division- approved designs, the material that has been
continuously exposed to impounded wastes shall be sampled and tested for permeability
as specified in the regulations that are applicable at that time at intervals of not more than
five years.

9.0 RECORDKEEPING
Monthly summary records shall be maintained until final closure of the facility
documenting the origin, volume in storage, shipment to other facilities, and rate of
disposal of all wastes. All records, including but not limited to facility inspection logs,
weekly depth readings, precipitation, waste and monitoring analyses, and load receipts
shall be maintained and available for inspection by representatives of the Department at
all times. Copies of the records will be kept at the landfill office.
10.0 GROUNDWATER MONITORING
The Southside Landfill has a groundwater- monitoring program in place. The program is
based on the Site -Wide Hydrogeolgic Investigation report prepared by Ayres Associates,
April 2000. Additional monitoring wells are not proposed for the impoundments.
Groundwater impacts are not anticipated since there are multiple control systems, i.e.:
• A membrane liner
• Leak detection and liquid collection system
• A geosysnthetic clay liner (GCL)
• A 12 -inch minimum compacted shale bedding layer
• Approximate 100 -foot thick native undisturbed Blue Hill Shale Formation
Additional groundwater monitoring wells located adjacent to the impoundments may be
considered if there is reason to suspect that the leak detection and liquid collection system
is not functioning as designed. The owner /operator will work closely with the City of
Pueblo and the Department to develop an appropriate monitoring program.
11.0 CLOSURE
Closure of the impoundment shall consist of the following actions:
• Remove all liquids, if any, and transport to appropriate liquid waste treatment
facility,
• Remove all lining material and solids and dispose in landfill,
• Test soil and, if necessary, treat to acceptable standards or transport to appropriate
disposal facility.
• Grade area to conform with surrounding topography, and
• Revegetate area using procedures and materials specified in the Southside
Landfill Design and Operation Plan.
12.0 POST - CLOSURE
Post- closure care will consist of inspection of area for erosion and poor vegetation and
making the necessary repairs. Groundwater monitoring will be done in accordance with
the Southside Landfill Design and Operation Plan.

13.0 FINANCIAL ASSURANCE
The financial assurance for the Southside Landfill will be adjusted to incorporate closure
and post - closure of the impoundments. The financial assurance will be completed prior
to acceptance of placing waste in the impoundments.
