ORDINANCE NO. 7119
AN ORDINANCE AMENDING SECTION 27 OF CHAPTER 3, TITLE VII OF THE PUEBLO
MUNICIPAL CODE RELATING TO LITTER AND THE POSTING OF NOTICES AND
ESTABLISHING STANDARDS THEREFOR
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: (brackets indicate matter

SECTION 1 _
Section 27 of Chapter 3, Title VII of the Pueblo Municipal Code is hereby amended to read
as follows:
Sec. 7 -3 -27. Posting Notices Prohibited.
(a) It shall be unlawful for any person to post or affix any notice, poster or other
paper or device, calculated to attract the attention of the public, to any lamp post, public
utility pole or shade tree, or upon any public structure or building, except as may be
authorized or required by law.
(b) Notwithstanding the provisions of subsection (a) above, Section 4- 9 -2(d)
403.5.1 and Section 9- 10 -88(a) of this Code, the City Manager upon recommendation of
the Chief of Police may, with the consent of the owner of wooden public utility poles,
authorize the posting of rewards or other notices ( "notices ") with the use of staples or tape
only on wooden public utility poles located within the public right -of -way which may assist
law enforcement agencies in the apprehension, arrest and conviction of persons for the
unsolved crimes of murder, manslaughter, and vehicular homicide, subject to the following
standards. conditions and reauirements:
No more than two hundred fifty (250) notices and an additional two
hundred fifty (250) if, in the discretion of the Chief of Police, it would be beneficial,
relatina to the same unsolved crime shall be posted at the same time within the Citv.
Notices shall not be posted for more than a one hundred eighty (180)
day period, with the City Manager authorized to grant additional periods of 180
days. Notices shall be removed within 10 days upon the expiration of the posting
period or expiration of additional oostina periods. if aranted. or the crime beina
solved. whichever occurs first
(3) Notices shall not be more than two hundred sixty (260) square inches
in size, be laminated, approved by the Chief of Police as to size and
quality, and be maintained in good order and condition.
(4) Notices in violation of paragraphs (1), (2), and (3) above or posted on
structures or facilities other than wooden public utility poles may be
removed and destroyed by the City without notice or liability.
No posting of notices shall be authorized within the state h
system or areas adjacent to the state highway system.
SECTION 2
This Ordinance shall become effective upon final passage and approval, and Section 7 -3-
27(b) shall automatically be repealed effective April 12, 2006, unless extended by the City Council
by ordinance.
