AN ORDINANCE VACATING A PORTION OF DRAINAGE EASEMENT
LYING WITHIN NORTH PUEBLO COMMERCIAL PARK
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that:
SECTION 1.
A portion of drainage easement lying within North Pueblo Commercial Park, and more
particularly described as follows:
A PARCEL OF LAND LOCATED IN THE SOUTHEAST QUARTER OF SECTION 12,
AND THE NORTHEAST QUARTER OF SECTION 13, TOWNSHIP 20 SOUTH,
RANGE 65 WEST OF THE SIXTH PRINCIPAL MERIDIAN, BEING PART OF LOT 1
BLOCK 1 NORTH PUEBLO COMMERCIAL PARK FILING NO. 1, IN THE CITY OF
PUEBLO, COUNTY OF PUEBLO, STATE OF COLORADO, DESCRIBED AS
FOLLOWS:
COMMENCING AT THE SOUTHWESTERLY CORNER OF SAID LOT 1 BLOCK 1,;
THENCE ALONG THE WESTERLY LINE OF SAID LOT 1, NORTH 04 DEGREES 18
MINUTES 36 SECONDS WEST A DISTANCE OF 151.40 FEET TO THE POINT OF
BEGINNING, BEING ON THE WESTERLY LINE OF SAID LOT 1, AND THE
SOUTHWESTERLY CORNER OF A PLATTED DRAINAGE EASEMENT AS

NO. 1; THENCE ALONG THE SOUTHWESTERLY LINE OF SAID LOT 1 AND SAID

OF 450.00 FEET; THENCE SOUTH 89 DEGREES 44 MINUTES 26 SECONDS EAST,
A DISTANCE OF 50.85 FEET TO THE EASTERLY LINE OF SAID DRAINAGE
EASEMENT; THENCE ALONG SAID EASTERLY LINE SOUTH 00 DEGREES 15
MINUTES 34 SECONDS WEST, A DISTANCE OF 501.23 FEET TO THE
SOUTHERLY LINE OF SAID DRAINAGE EASEMENT AND THE NORTHERLY LINE
OF A VACATED RIGHT OF WAY, VACATED BY RECEPTION NO. 1145922 BOOK
2944 PAGE 489; THENCE ALONG SAID SOUTHERLY LINE, 110.89 FEET ALONG
THE ARC OF A NON - TANGENT CURVE TO THE LEFT HAVING A RADIUS OF
440.00 FEET, A CENTRAL ANGLE OF 14 DEGREES 26 MINUTES 25 SECONDS,

ISSUE
Shall City Council approve the vacation of the drainage easement?
RECOMMENDATION
The Planning and Zoning Commission voted 7 -0 to recommend approval.
BACKGROUND
The applicant is requesting to vacate a portion of a drainage easement in order
to erect a freestanding sign for the existing business (Sam's Club Wholesale
Warehouse). All of the conditions of approval from the Planning and Zoning
Commission have been addressed to the satisfaction of the Director of Public
Works.
