HomeMy WebLinkAbout07074ORDINANCE NO. 7074 AN ORDINANCE AMENDING SECTION 7 OF CHAPTER 1 OF TITLE XV OF THE PUEBLO MUNICIPAL CODE PROHIBITING THE UNAUTHORIZED PARKING OF AUTOMOBILES OR OTHER MOTOR VEHICLES UPON PRIVATELY OWNED PARKING LOTS AND PROVIDING PENALTIES FOR VIOLATIONS THEREOF BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: (Brackets indicate matter deleted, underscoring indicates matter added.) SECTION 1. Section 7 of Chapter 1 of Title XV of the Pueblo Municipal Code is hereby amended to read as follows: Sec. 15 -1 -7. Parking on private property; burden of proof. (a) It shall be unlawful for any person to park, leave or cause to be parked or left any automobile or other motor vehicle on the premises of another after having been warned not to do so by word of mouth, sign or otherwise[; provided that this Section shall not apply to employees of the City in the discharge of their official duties]. On those areas of private property available for public use where designated parking areas or individual spaces have been clearly identified by signs, markings or otherwise, it shall be unlawful and a municipal offense for any person to Dark any automobile or other motor vehicle other than completely within the area or individual space designated for barking. It shall be an affirmative defense to any such violation that the automobile or other motor vehicle was parked, contrary to the requirements of this subsection, with the consent of the owner or person in lawful possession of the private ro e [(b)]u The presence of an unattended automobile or other motor vehicle on the premises of one who is not the owner or in control of such vehicle shall create a prima facie presumption that the registered owner of such vehicle did then and there park, leave or cause to be parked or left the vehicle on such premises, and the burden of proof shall be upon the registered owner to show otherwise. u This section shall not apply to emplovees of the City in the discharge of their official duties. SECTION 2. Every person convicted of a violation of Section 15 -1 -7 shall be punished as provided in Section 15 -1 -6 of the Pueblo Municipal Code. SECTION 3. If any part, section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this Ordinance. SECTION 4. This Ordinance shall become effective immediately upon final passage and approval.
