HomeMy WebLinkAbout07064ORDINANCE NO. 7064 AN ORDINANCE AUTHORIZING THE ISSUANCE OF A BUILDING PERMIT FOR THE PROPERTY DESCRIBED AS LOTS 1, 2 AND 3, ST. MARY - CORWIN HOSPITAL SUBDIVISION NO. 2 BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1 Due to exigent circumstances, contemporaneously with the filing of a complete resubdivision application ( "Subdivision ") for the property described as Lots 1, 2 and 3, St. Mary- Corwin Hospital Subdivision No. 2, Pueblo, Colorado ("Property") the City administration is authorized to approve the issuance of a building permit for a building or structure to be remodeled, constructed or installed on the Property (`Building Permit'). SECTION 2 The Building Permit will be deemed to be revoked and cancelled if the owner of the Property does not diligently pursue the approval of the Subdivision. No certificate of occupancy shall be issued for any building or structure remodeled, constructed or installed on the Property pursuant to such Building Permit until after the Subdivision has been finally approved by City Council. This Ordinance and these restrictions and limitations shall be incorporated in and made a part of the Building Permit. SECTION 3 All Ordinances of the City inconsistent with this Ordinance shall to the extent of such inconsistency be deemed to be suspended for the sole purpose of this Ordinance. SECTION 4 This Ordinance shall be effective upon final passage and approval. MARY - CORWIN HOSPITAL SUBDIVISION NO. 2 ISSUE Should the City Council approve an Ordinance authorizing the issuance of a building permit before final resubdivision of an existing approved subdivision? RECOMMENDATION Approve the Ordinance. BACKGROUND St. Mary- Corwin Hospital plans for expansion of its southside campus and will be required to resubdivide Lots 1, 2 and 3, St. Mary- Corwin Subdivision No. 2, an approved subdivision, into one lot in order to accommodate such expansion. The resubdivision process has commenced butwill not be completed fora period of time which will materially interfere with the timing of the construction of its initial building expansion. St. Mary- Corwin Hospital has requested that the City Council authorize the issuance of a building permit before final resubdivision conditioned upon completion of the resubdivision. FINANCIAL IMPACT None.
