HomeMy WebLinkAbout07053Reception 1539255 12/01/2003 ORDINANCE NO. 7053 AN ORDINANCE APPROVING SEVEN OAKS CONDOMINIUMS SPECIAL AREA PLAN WHEREAS, Seven Oaks Condominiums Special Area Plan has been submitted to the Planning and Zoning Commission for approval pursuant to Section 17 -4 -29 of the Pueblo Municipal Code, and WHEREAS, the Planning and Zoning Commission after a public hearing found and determined the objectives and requirements of said Section 17 -4 -29 can and will be met, and WHEREAS, the Planning and Zoning Commission has recommended the approval of Seven Oaks Condominiums Special Area Plan without conditions: NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The Seven Oaks Condominiums Special Area Plan being a special area plan of land described as follows: In Parcel 'A' of the rearrangement of property boundaries of Lots 8, 9, 10 and 11, in Pueblo Metro - Center Mall, Filing No. 4, A Special Area Plan, Is hereby approved. JORDAN, AICP TITLE AN ORDINANCE APPROVING SEVEN OAKS CONDOMINIUMS SPECIAL AREA PLAN ISSUE Shall City Council approve a request to combine four (4) lots into one site for the purposes of constructing 34 town homes with common amenities and private road (Redwood Lane)? RECOMMENDATION The Planning Commission voted unanimously (6 -0) to recommend approval. BACKGROUND The applicant is proposing to construct 34 town homes in 8 detached structures. The development will also have common amenities and will be built with a private street (Redwood Lane). Due to a residential use being a Use by Review in the B- 4 zone district, this proposal also went before the Zoning Board of Appeals (ZBA). It was approved with conditions on 2.25.03. The applicant has addressed, to the satisfaction of the Director of Public Works, all of the items that were identified in the Planning Commission's approval, which included the ZBA's conditions.
