AN ORDINANCE AMENDING PRIOR YEARS 1998 -2002 CDBG PROJECT BUDGETS, AMENDING
FY 2003 ANNUAL ACTION PLAN FOR CDBG AND HOME BUDGETS ADOPTED BY ORDINANCE
NO. 6922, REAPPROPRIATING UNSPENT AND UNENCUMBERED COMMUNITY DEVELOPMENT
BLOCK GRANT FUNDS BETWEEN VARIOUS COMMUNITY DEVELOPMENT BLOCK GRANT
PROJECTS, AND APPROPRIATING FUNDS FOR NEW CDBG PROJECTS AS RECOMMENDED
BY THE CITIZEN ADVISORY COMMITTEE
WHEREAS, the City of Pueblo is designated as an entitlement city under the Housing and
Community Development Act of 1974, and has received in prior years Community Development Block
Grant and HOME federal funds; and
WHEREAS, the Council of the City of Pueblo, Colorado has heretofore passed and adopted
Ordinance No. 6922, which ordinance set out the appropriations and the use of CDBG and HOME
budget for the fiscal year 2003; and
WHEREAS, the City of Pueblo annually reviews all CDBG prior years projects for completion
and unencumbered funds for reappropriation for new or current projects and conducts public hearings
before City Council to obtain the views of citizens, non - profit and neighborhood groups on the City's
housing and community needs; and
WHEREAS, the City Council scheduled a public hearing on this ordinance and such hearing
was held September 22, 2003.
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The City of Pueblo's 2003 One Year Action Plan budget adopted by Ordinance 6922 is hereby
amended by approving the projects listed in Exhibit B attached hereto and incorporated herein, that
will give maximum feasible priority to activities, which will benefit low- and moderate - income families
and /or aid in the prevention or elimination of slums and blight, and appropriating funds for said
projects in the amounts set forth in Exhibit B.
SECTION 2.
1998 -2003 CDBG project budgets and prior appropriations are adjusted and reappropriated in
Fund 250 in the amounts listed in Exhibit A, "CDBG PRIOR YEARS BUDGET ADJUSTMENTS"
attached hereto and incorporated herein.
SECTION 3.
The City of Pueblo's FY 2003 CDBG grant funds in the amount of $35,000 are budgeted and
appropriated to a project contingency sub - account. If an approved project exceeds the amount
appropriated for the project, the City Manager may transfer funds from the project contingency sub -
account for the project.
SECTION 4.
Program income from CDBG housing rehabilitation loans repaid by applicants shall be
deposited in the Housing Rehabilitation Revolving Loan Program ("Program ") as adopted by City
Council Resolution 6846 to promote the rehabilitation of existing owner —occupied residences for low
and moderate- income families. Program income in the amount of $ 195,157 on deposit in the
Program account is hereby appropriated for the Program.
SECTION 5.
This Ordinance shall become effective upon final passage.

VARIOUS COMMUNITY DEVELOPMENT BLOCK GRANT PROJECTS, AND
APPROPRIATING FUNDS FOR NEW CDBG PROJECTS AS RECOMMENDED BY THE
CITIZEN ADVISORY COMMITTEE
ISSUE
This amendment will reappropriate and transfer unspent CDBG funds resulting from closing
prior years CDBG projects, receiving an additional amount from HUD for FY 2003, and
program income receipts for FY 2003. The unspent CDBG funds will be reappropriated between
current 1998 -2003 CDBG projects, including amending Ordinance 6922 that adopted the CDBG
FY 2003 projects. This amendment will also fund new CDBG projects that have been
recommended by the Citizen Advisory Committee (CAC).
RECOMMENDATION
Staff recommends that City Council amend the CDBG project budgets for FY 1998- 2003 as
listed on Exhibit A and B, establish a contingency account, conduct a public hearing and approve
the recommendations of the Citizen Advisory Committee (CAC) for new CDBG projects.
BACKGROUND
Each year departmental staff reviews the status of prior years CDBG projects for completion and
budget status. Unencumbered funds determined to be available after project completion can be
reprogrammed for eligible uses under HUD guidelines. This process allows the City to meet
HUD requirements for disbursement of CDBG grant funds in a timely fashion. Staff has
completed review of prior years 1998 -2003 CDBG.
For "new" CDBG projects and major amendments made to the annual HUD One Year Action
Plan, a public hearing needs to be held. After due notice, the Citizen Advisory Committee
(CAC) conducted a public hearing on August 28, 2003, to hear presentations from various
groups and agencies for CDBG funding and new projects. The CAC again met on September 3,
2003, and finalized their funding recommendations. Applications were ranked by the CAC
based on a scoring system and the CAC funding recommendations are listed on Exhibit B.
FINANCIAL IMPACT
This Ordinance will reappropriate unspent CDBG funds between prior years and FY 2003
projects and close those projects that are completed. The Ordinance also replenishes a
"Contingency" sub - account that authorizes the City Manager to make budget transfers between
CDBG projects to facilitate project administration and contingencies related to projects.
