AN ORDINANCE CHANGING ZONING RESTRICTIONS FROM COUNTY 1 -2 TO S -1 COVERING
A PARCEL OF LAND COMMONLY KNOWN AS AIRPORT INDUSTRIAL PARK EAST LOCATED
AT THE EASTERN EDGE OF PUEBLO MEMORIAL AIRPORT INDUSTRIAL PARK
SUBDIVISION
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The zoning restrictions covering the following described property be changed from County
1 -2, Light Industrial District, to S -1, Governmental Use District, and upon passage of this ordinance,
zoning restrictions affecting S-1, Governmental Use District shall apply to said property:
Parcel M, Pueblo Memorial Airport Industrial Park Subdivision containing 6.57 acres, more
or less; and Lot 69 and Parcel K adjacent therefore, Pueblo Memorial Airport Industrial Park
Subdivision containing 72.61 acres, more or less; together containing 79.18, more or less,
and more commonly known as:
Eastern Edge of Pueblo Memorial Airport Industrial Park.
SECTION 2.
The City Council hereby finds and determines: (a) The use of Lot 69, Pueblo Memorial
Airport Industrial Park ( "Lot 69 ") for a correctional or detention facility ( "Facility"), is exclusively for
governmental purposes; (b) The construction and operation of the Facility by a non - governmental
entity under contract with a governmental agency constitutes a use by such governmental agency
in discharge of its governmental duties; and, (c) The Facility and such use constitute a use by right
under Governmental Use District (S -1).
SECTION 3.
Lot 69 and the Facility shall be developed, constructed and operated in compliance with the
representations, warranties, covenants and agreements of Wackenhut Corrections Corporation set
forth and contained in the Contract To Buy And Sell Real Estate dated as of July 28, 2003 between
the City and Wackenhut Corrections Corporation which are incorporated herein by reference.
SECTION 4.
This ordinance shall become effective immediately upon final passage and approval.

ISSUE
Shall City Council approve a request to rezone the property to an S -1,
Governmental Use District?
RECOMMENDATION
The Planning and Zoning Commission voted 6 -0 to recommend approval.
BACKGROUND
Located at the eastern edge of the Airport Industrial Park, this property was
recently annexed into the City as the future site of a correction /detention facility.
As part of that annexation process, it was determined that the property must be
rezoned to an S -1 zone district. This rezoning request fulfills that requirement.

City of Pueblo).
Ms. Jordan presented the staff report. Mr. Munch reviewed the " Contract to Buy and Sell Real
Estate that was distributed to the Commission.
Frank Lauer, attorney and Phil Mosciski, Vice - President of Construction and Design for WCC,
appeared in support of the application.
No one else appeared. Mr. Johnson, seconded by Mr. Thomas, moved to recommend approval of
the rezoning with the condition that the development would require the prior review and approval
by the Planning and Zoning Commission for 17 -4 -51 (16b).
Motion carried 6 -0 -0.

CHARACTER AND COMPATIBILITY
Site Character: Vacant industrial land
Neighborhood Compatibility: The proposed zone district is compatible with the existing and
proposed surrounding land uses.
Plan Compliance: The proposed zone change complies with the Pueblo
Comprehensive Development Plan.
ABILITY TO COMPLY WITH PROPOSED ZONE DISTRICT
Parking and Access: Adequate off - street parking as per § 17 -4 -43, shall be addressed with the
final review of the proposed site plan by Transportation.
Landscaping: The final landscaping plan shall be reviewed prior to the signing off of
the routing slip for any site or building development.
S -1 Use by Right The Planning Commission will review the proposed development of the
review: site as per the allowances of the S -1 zone district as a Use by Right.
ZONING AMENDMENT TEST:
The standard for accepting an amendment to the zoning map is that the proposed zoning action
must either: 1) further the goals and objectives of the comprehensive land use plan, or 2) show
that the area has changed significantly since the adoption of the comprehensive land use plan, or
3) show that there was a mistake or error made in the original zoning of the property.
Does the request meet one of these tests?

Yes, this application furthers the goals and objectives of the comprehensive land use plan.
Additionally, it will rezone the recently annexed property from a County I -2 zone district to a
zone district appropriate to the prison development of the site (S -1).
