HomeMy WebLinkAbout07036ORDINANCE NO. 7036 AN ORDINANCE CHANGING ZONING RESTRICTIONS FROM A -4 TO R -5 COVERING A PARCEL OF LAND COMMONLY KNOWN AS 4121 NATURE CENTER ROAD BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that SECTION 1 The zoning restrictions covering the following described property be changed from A -4, Agricultural Four District, to R -5, Multiple - Residential and Office District, and upon passage of this ordinance, zoning restrictions affecting R -5, Multiple - Residential and Office District shall apply to said property: A Portion of Block 51 of Westside Addition and a portion of vacated 10` Street and Amherst Avenue, being more particularly described as follows: Beginning at the Intersection of the North Line of the SE '/4 or the SE '/4 of Section 28, Township 20 South, Range 65 West of the 6` P.M., and the West line of said Block 51, extended Northerly; Thence Easterly along the North line of the SE' /4 of the SE 1 /4 a distance of 322.9 feet, Thence South 14 °09' West, a distance of 174.55 feet, to the Northerly line of a roadway; Thence South 62 °22' West, along said Northerly line of a roadway, A distance of 317.04 feet, to the West line extended of said Block 51, Thence North 0 0 07' East, along the West line and the West line extended of said Block 51, a distance of 316.3 feet to the Point of Beginning, County of Pueblo, State of Colorado, and more commonly known as: 4121 Nature Center Road. SECTION 2. (a) This ordinance is approved upon the following condition: The applicant shall verify with the Planning Department within ninety (90) days of final approval that the requirements of the Landscape Code ( §17 -4 -7) have been met, or the owner shall be in violation of Title 17. (b) If the above condition is not completed within a reasonable period not to exceed six months from the effective date of this Ordinance, the Planning and Zoning Commission shall institute proceedings to rezone the property to A -4, Agricultural Four District. SECTION 3. This ordinance shall become effective immediately upon final passage and approval.
