HomeMy WebLinkAbout07035SUBSTITUTED COPY 8/6/03 ORDINANCE NO. 7035 AN ORDINANCE CHANGING ZONING RESTRICTIONS FROM R -2, R -3 AND R-4 TO R-4 COVERING A PARCEL OF LAND COMMONLY KNOWN AS 1825 WEST STREET BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The zoning restrictions covering the following described property be changed from R -2, Single - Family Residential District; R -3, One and Two - Family Residential District; and R -4, Mixed Residential District, and upon passage of this ordinance, zoning restrictions affecting R4, Mixed Residential District shall apply to said property: Fractional Lots 30, 31 and 32 of fractional Block 25, Dundee Place, and also a track of land lying immediately in the rear of and adjoining Lots 30, 31 and 32, fractional Block 25, Dundee Place, said tract of land being 75 feet in length extending North and South and 70 feet more or less extending East and West and bounded as follows: on the North by the North boundary line of said Lot 32 if the same were extended Westward, on the East by the West boundary line of said Lots 30, 31 and 32, on the South boundary line of said Lot 30, if the same were extended Westward, and on the West by a tract of land conveyed to Christopher F. Tonne, Et Al, in Warranty Deed Recorded in Book 1740 at Page 230, Instrument No. 442459, at a distance of 70 feet, more or less, of the Westerly boundary line of said Lots 30, 31 and 32, together an adjacent parcel on the northerly side of the parcels described above being the Southerly 27 feet of vacated 19 Street, extended Westward from the West line of West Street to the East property line of School District 60, a distance of 168.76 feet, County of Pueblo, State of Colorado, and more commonly known as: 1825 West Street. SECTION 2. (1) (a) This ordinance is approved upon the following conditions: 1. The applicant shall submit a revised site plan acceptable to the Land Use Administration Department prior to the signing off of a permit sign -off slip, which shall include the following: • Six parking spaces as per the requirements the Department of Transportation; and • Paved parking and drive aisle (12 -14' wide) 2. The applicant shall meet the requirements of the Title 17-4 -7 (Landscape Code) 3. A lot line rearrangement shall be completed for the parcel on which the residential unit exists within six (6) months of final approval. (b) If the above conditions are not completed within a reasonable period not to exceed six months from the effective date of this Ordinance, the Planning and Zoning Commission shall institute proceedings to rezone the property to an R -2, Single - Family Residential District; R -3, One and Two - Family Residential District; and R -4, Mixed Residential District. SECTION 3. This ordinance shall become effective immediately upon final passage and approval.
