HomeMy WebLinkAbout07010ORDINANCE NO. 7010 AN ORDINANCE APPROVING A CONTRACT BETWEEN THE CITY OF PUEBLO, A MUNICIPAL CORPORATION, AND THE STATE OF COLORADO RELATING TO THE ACQUISITION OF THE GOODNIGHT BARN, AND AUTHORIZING THE PRESIDENT OF CITY COUNCIL TO EXECUTE SAME WHEREAS, City Council supported a grant application to the Colorado State Historic Fund to secure funding for the acquisition of the historic Goodnight Barn; and WHEREAS, the City of Pueblo has received a grant from the Colorado Historical Society to fund the acquisition of the historic Goodnight Barn property, subject to the execution of a Contract; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The grant Contract and Attachments between the City of Pueblo, a municipal corporation and the State of Colorado for the use and benefit of the Colorado Historical Society, relating to the acquisition of the Goodnight Barn (Colorado Historical Society Project #2002 -02 -027), copies of which are attached hereto and incorporated herein, having been approved as to form by the City Attorney, are hereby approved. SECTION 2. The President of the City Council is hereby authorized to execute and deliver said Contract and the Agreement attached thereto in the name of and on behalf of the City of Pueblo, a Municipal Corporation, and the City Clerk shall affix the seal of the City thereto and attest same. SECTION 3. Funds in the amount of $220,000 has been budgeted and appropriated in Project No. CP- 0239, and pledged to meet the City of Pueblo's financial obligations subject to the approval of this Grant Agreement with the State of Colorado. SECTION 4. The ordinance will become effective upon final passage. Approval of the Ordinance. BACKGROUND The City will be committing to complete the purchase of 1.5 acres of property including the Goodnight Barn using $165,000 of Colorado State Historic Funds. The property is currently owned by Transit Mix, Inc., and used for a gravel and concrete batch plant operation. Transit Mix, Inc., has moved its operations to another location in Pueblo County and is currently in the process of closing its operation at the site. An access easement is being acquired by the City as part of the Army Corps of Engineers Arkansas River Restoration Project. This easement will provide access to the Arkansas River, as well as the Goodnight Barn property. The seven grandchildren of Elizabeth Hudspeth have requested the funds from the Elizabeth Hudspeth Park Fund in the amount of $26,050 be utilized for the acquisition and preservation of the Goodnight Barn. Mrs. Hudspeth lived on the Goodnight Ranch property for more than fifty years. She originally donated the funds to the City for improvements to Hudspeth Park which to date has not been developed. If the parts is developed in the future funds from fees in -lieu of park land dedication will be used to develop the park. The grandchildren have all signed requests for the funds to be utilized for the purchase of the Goodnight Barn. The signed statements are on file in the Planning & Community Development Department. The budget for the project is $220,000, which includes the following funding sources: $165,000 Colorado Historical Society $ 26,050 Elizabeth Hudspeth Park Fund $ 13,000 Pueblo County Historical Society (contributions from Packard Foundation $6,000; Chamberlain Foundation $4,000; Christmas Foundation $3,000) $ 15,950 Frontier Pathways Nat. Scenic & Historic Byway (Federal Highways Byway Grant ($14,950 and donation of $1,000) $220,000 TOTAL COST The Goodnight Barn is the last remaining structure of the Goodnight's Rock Canyon Ranch, which was established in 1869. The structure was placed on the National Register of Historic Places on July 30, 1974. The Barn was stabilized and new roof was added in 1997 with funds provided by the State Historical Society and Pueblo County. The acquisition will alleviate the threat of the Barn being sold to the National Ranching Heritage Center, a part of Texas Tech University. FINANCIAL IMPACT The City of Pueblo will receive 40% of the $165,000 grant award at the beginning of the project, another 50% mid -way through the project, and the final 10% upon completion of the project. Funds in the amount of $220,000 has been budgeted and appropriated in Project No. CP -0239. The City will be required to maintain the building in a good and sound state of repair and to maintain the Property to prevent deterioration of the structure. The Barn structure will be secured and closed to the public (except for authorized public activities) until the management and funding for the structure is finalized. The Frontier Pathways Scenic Byway, Inc., has indicated a willingness to undertake responsibilities for conducting tours, general cleanup, and oversight of the building and grounds.
