AN ORDINANCE AMENDING CHAPTER 4 OF TITLE XI OF THE PUEBLO MUNICIPAL CODE
RELATING TO DOG AND CAT LICENSING, PROVIDING PENALTIES FOR VIOLATION
THEREOF, AND REPEALING ORDINANCE NO. 6976
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: (brackets indicate matter
deleted, underscoring indicates matter added)
SECTION 1
Section 11- 4 -43(a) of the Pueblo Municipal Code is amended to read as follows:
(a) It shall be unlawful and a Class 2 municipal offense for any person to own,
keep or harbor a dog or cat over the age of [four (4)] sixLM months within the City without
obtaining a license for such dog or cat.
SECTION 2
Section 11 -4 -48 of the Pueblo Municipal Code is repealed in its entirety and reenacted to
read as follows:
[It shall be unlawful and a Class 2 municipal offense for any person other than the
Shelter Operator to display any dog or cat in a public place for the purpose of selling or
giving the dog or cat away. Public place shall include, but not be limited to, streets,
highways, sidewalks, areas exterior to shops or businesses, carnivals and flea markets.]
(a) No person shall display any dog or cat for the purpose of selling or giving the
dog or cat away.
(ij on any street highway, alley, sidewalk public place or park; or,
(Q in an open area where the public is invited by the owner or person
controlling such area including but not limited to areas exterior to shops or businesses
carnivals and flea markets.
(b) Subsection (a)(2) above shall not be applicable to the display of any dog or
cat for adoption by the Shelter Operator or by a tax exempt non - profit organization whose
purpose is to protect dogs and cats including the humane treatment and disposition of dogs
and cats provided however, that such organization (i) holds a current license issued under
the Colorado Pet Animal Care and Facilities Act for a pet animal facility located in Pueblo
County Colorado (ii) does not engage in the business of breeding or raising dogs or cats
and (iii) does not coax or caiole any person to adopt a dog or cat.
Uc It shall be unlawful and a Class 2 municipal offense for any person to violate
any provision of this Section.
SECTION 2
Ordinance No. 6976 is hereby repealed. This Ordinance shall become effective upon final
passage and adoption.
