HomeMy WebLinkAbout06998ORDINANCE NO. 6998 AN ORDINANCE AMENDING CHAPTER 2 OF TITLE XVII OF THE PUEBLO MUNICIPAL CODE RELATING TO ZONING DEFINITIONS BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: (Brackets indicate material deleted, underscoring indicates material added.) SECTION 1. Section 17- 2 -1(6) of the Pueblo Municipal Code is hereby amended by the addition of a new subsection (6.01) to read as follows: ( 6.01) Administrative Official shall mean the Director of the Department of Land Use Administration or the person designated by the City Manager to administer and enforce this Title. SECTION 2. Section 17 -2 -1(24) of the Pueblo Municipal Code is hereby repealed and reacted to read as follows: (24) Height, building means the vertical distance from the grade plane to the average height of the highest roof surface. [to the highest point of the coping of a flat roof, to the deck line of a mansard roof or to the average height of the highest gable of a pitch or hip roof.] Height means, when referring to a tower or other antenna structure, the distance measured from the finished grade of the parcel to the highest point on the tower or other structure, including the base [paid] and any antenna. (See Section 17-4, Article IV, Tower and Antenna Requirements). (a) Flat Roof. Building height shall be measured as the vertical distance from the mean level of the finished grade of the front of the building to the highest point on the finished roof. (b) Pitched Roof Building height shall be measured as the vertical distance from the mean level of the finished -grade of the front of the building to the average height of the rise of the pitched roof. (c) Curved Roof. Building height shall be measured as the vertical distance from the mean level of the finished grade of the front of the building to a point two- thirds the vertical height of the curve. (d) Other Forms: Building height shall be measured and determined by the Administrative Officer in a manner that most closely reflects the intent of subsections (a) through (c) and attains a height which is similar to adjacent complying structures. (e) Comer Lots: Building height for corner lots shall be measured as the vertical distance from the mean level of the front of the building along the street having the lower record grade. (f) Lots Fronting on Two Streets: Where a parcel, other than a comer lot, fronts on two streets the maximum heiaht shall then be measured separately for each of the two (2) frontages of the building from the mean level of the finished grade. The maximum height so measured shall apply on each street. (a) Lots Fronting on More than Two Streets: Where a lot fronts on three (3) or more streets, building height shall be measured from the mean level of the front of the building along the street havina the lowers record grade. (h) Antenna or Tower Structure: Shall be measured from the finished grade of the parcel to the highest point on the tower or other structure, which shall include the base and any antenna. (See Section 17-4, Article IV. Tower and Antenna Requirements). SECTION 3. This Ordinance shall become effective upon final passage and approval.
