HomeMy WebLinkAbout10747ORDINANCE NO. 10747 AN ORDINANCE APPROVING THREE MAIN EXTENSION AGREEMENTS BETWEEN THE CITY OF PUEBLO, A COLORADO MUNICIPAL CORPORATION, AND THE BOARD OF WATER WORKS OF PUEBLO, COLORADO RELATED TO THE EXTENSION OF WATER MAINS TO SERVE THE CITY'S THREE NEW FIRE STATIONS, AND AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENTS BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. Three Main Extension Agreements between the City of Pueblo, a Colorado Municipal Corporation, and the Board of Water Works of Pueblo, Colorado, copies of which are attached hereto, having been approved as to form by the City of Pueblo Attorney, are hereby approved. SECTION 2. The Mayor is authorized to execute and deliver the Main Extension Agreements in the name of the City of Pueblo, and the City Clerk is directed to affix the seal of the City thereto and attest same. SECTION 3. The officers of the City of Pueblo are authorized to perform any and all acts consistent with this Ordinance to implement the policies and procedures described herein. SECTION 4. This Ordinance shall become effective on the date of final action by the Mayor and City Council. Action by City Council: Introduced and initial adoption of Ordinance by City Council on July 22, 2024. The agreements outline the parties' obligations with respect to the extension of water mains required to provide water service to the City's three new fire station facilities (i.e., Fire Station 6 at 111 Victory Lane; Fire Station 8 at 4405 Jerry Murphy Road; and Fire Station 11 at 3205 W. 24th Street). The Ordinance also authorizes the Mayor to sign all three agreements. PREVIOUS COUNCIL ACTION: None. BACKGROUND: The City has awarded a contract for the construction of three new fire stations. All three fire station sites require the extension of water mains to support the new facilities. BOWW requires that builders/developers enter into agreements regarding the parties' respective obligations and covering terms and conditions related to the main extensions. This Ordinance approves three main extension agreements between the City and BOWW and authorizes the Mayor to sign the agreements. FINANCIAL IMPLICATIONS: The City is responsible for the cost of installing the three required water mains to serve the new fire stations. The cost associated with extending the mains has already been budgeted and appropriated in the construction project account. The work to install the new lines is also already included in the previously-awarded construction contract. No additional funds are required to be budgeted and appropriated to complete this work. BOWW is requiring that the water main serving the new Fire Station No. 8 that will be installed in Jerry Murphy Road be sized at 16 inches because it serves additional properties to the north of the fire station. When developers are required to install larger mains that serve adjacent development areas, they may be eligible for reimbursement of a portion of the cost of the installed pipe after it has been accepted by BOWW. In this case, the City will be eligible for reimbursement of $40,089.92 for the main extension being installed in Jerry Murphy Road following BOWW's acceptance of the new main extension. The main extensions on Victory Lane and W. 24th Street are not eligible for reimbursement due to their size. BOARD/COMMISSION RECOMMENDATION: Not applicable to this Ordinance. STAKEHOLDER PROCESS: None. ALTERNATIVES: Failure to approve these agreements will prevent the City from being able to connect the three new fire stations to the BOWW distribution system. RECOMMENDATION: Approval of the Ordinance.
