HomeMy WebLinkAbout15707RESOLUTION NO. 15707 A RESOLUTION APPROVING CONTRACT AMENDMENT NO. 1 IN THE AMOUNT OF $36,309.50 TO BAHA CONSTRUCTION, INC., FOR PROJECT NO. 23-122, FIRE STATION #5 TRUCK BAY CONCRETE REPLACEMENT, AND AUTHORIZING THE PURCHASING AGENT TO EXECUTE SAME WHEREAS, a Construction Contract was awarded to Baha Construction, Inc., under Contract Number 23-122; and WHEREAS, a construction amendment is requested for the purpose of additional work necessary to complete the project; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that SECTION 1. Contract Amendment No. 1 to the Construction Contract for Fire Station #5 Truck Bay Concrete Replacement with Baha Construction, Inc., Project No. 23-122, in the amount of $36,309.50, a copy of which is attached hereto, having been approved as to form by the City Attorney, is hereby approved, and City Council authorizes the additional work contemplated by the Amendment. SECTION 2. The Purchasing Agent is hereby authorized to execute said Amendment on behalf of the City of Pueblo, a Municipal Corporation, and the City Clerk shall affix the seal of the City thereto and attest same. SECTION 3. Funds for Project 23-122 shall be from Project Account CIAN20, City Building Maintenance. SECTION 4. The officers and staff of the City of Pueblo are authorized to perform any and all acts consistent with this Resolution and the Amendment to implement the transactions described herein. Furthermore, all actions previously taken by officers and staff of the City consistent with the Amendment, including any payments authorized under the contract, are hereby ratified. SECTION 5. This Resolution shall become effective immediately upon passage and approval. PREVIOUS COUNCIL ACTION: Resolution 15371, dated September 11, 2023, awarded a Construction Contract, in the amount of $87,650.00, to Baha Construction, Inc., and set forth $17,530.00 for contingencies and additional work, for Project No. 23-122 Fire Station #5 Truck Bay Concrete Replacement. BACKGROUND: The original project, awarded to Baha Construction, Inc., consisted of the replacement of the concrete flooring and subbase under the truck bays at Fire Station #5. Contract Amendment No. 1 reflects the following additional work: 1.) installation of two (2) new sandtraps to current building standards, 2.) removal and replacement of gym areas at the back of the fire station, 3.) installation of plumbing to bring sandtraps to code, 4.) installation of plumbing for drains for sink and washer, 5.) Demo wall to the trough and fill with concrete to make the concrete drain to the middle of the floor. The cost of the additional work exceeds the threshold for administrative approval of a change order and a contract amendment will be required to award and complete the additional work. This Resolution approves an amendment to increase the contract award amount previously awarded to Baha Construction, Inc. FINANCIAL IMPLICATIONS: City Council previously awarded Resolution 15371 with a contingency amount of $17,530.00, this Resolution approves an additional $18,779.50 to be paid from Project Account CIAN20, City Building Repairs. BOARD/COMMISSION RECOMMENDATION: None. STAKEHOLDER PROCESS: None. ALTERNATIVES: Denial of this Resolution would cancel the additional work necessary to complete the project. RECOMMENDATION: Approval of the Resolution.
