A RESOLUTION APPROVING CONTRACT AMENDMENT NO. 1
IN THE AMOUNT OF $55,032.44 TO A5 CONSTRUCTION, LLC.,
FOR PROJECT NO. 24-003, CONCRETE IMPROVEMENTS
CHEYENNE AVENUE (19TH TO 29TH), AND AUTHORIZING
THE PURCHASING AGENT TO EXECUTE SAME
WHEREAS, a Construction Contract was awarded to A5 Construction, LLC, under
Contract Number 24-003; and
WHEREAS, a contract amendment is requested for the purpose of constructing
additional sidewalk to complete the project; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that
SECTION 1.
Contract Amendment No. 1 to the Construction Contract for Concrete Improvements
Cheyenne Avenue (19th to 29th) with A5 Construction, LLC, Project No. 24-003, in the amount
of $55,032.44, a copy of which is attached hereto, having been approved as to form by the City
Attorney, is hereby approved, and City Council authorizes the additional work contemplated by
the Amendment.
SECTION 2.
The Purchasing Agent is hereby authorized to execute said Amendment on behalf of the
City of Pueblo, a Municipal Corporation, and the City Clerk shall affix the seal of the City thereto
and attest same.
SECTION 3.
Funds for Project 24-003 shall be from Project Account CI2415, Street Rehabilitation.
SECTION 4.
The officers and staff of the City of Pueblo are authorized to perform any and all acts
consistent with this Resolution and the Amendment to implement the policies and procedures
described herein. Furthermore, all actions previously taken by officers and staff of the City
consistent with the Amendment, including any payments authorized under the contract, are
hereby ratified.
SECTION 5.
This Resolution shall become effective immediately upon passage and approval.

SUMMARY:
This Resolution approves Contract Amendment No. 1 in the amount of $55,032.44 to
A5 Construction, LLC, for Project No. 24-003 Concrete Improvements Cheyenne
Avenue (19th to 29th).
PREVIOUS COUNCIL ACTION:
Resolution 15526, dated March 11, 2024, awarded a Construction Contract, in the
amount of $373,877, to A5 Construction, LLC, and set forth $75,123 for contingencies
and additional work, for Project No. 24-003 Concrete Improvements Cheyenne
Avenue (19th to 29th).
BACKGROUND:
The original project, awarded to A5 Construction, LLC, consisted of concrete
improvements for ADA compliance along Cheyenne Avenue between 19th and 29th
Streets. Contract Amendment No. 1 reflects the cost to remobilize after Black Hills
Energy moved the power pole, additional traffic control after demobilization, and to
replace additional sidewalk for ADA compliance. The cost of the additional work
exceeds the threshold for administrative approval of a change order and a contract
amendment will be required to award and complete the additional work.
This Resolution approves an amendment to increase the contract award amount
previously awarded to A5 Construction, LLC.
FINANCIAL IMPLICATIONS:
Funding in the amount of $55,032.44 will be paid from Project Account CI2415, Street
Rehabilitation.
BOARD/COMMISSION RECOMMENDATION:
None.
STAKEHOLDER PROCESS:
None.
ALTERNATIVES:
Denial of this Resolution would cancel the additional work necessary to complete the
project.
RECOMMENDATION:
Approval of the Resolution.
