CI-2113 - AMERICAN RESCUE PLAN ACT, FOR THE PURPOSES OF ACQUIRING THE MANDATORY RAILROAD PERMITS NEEDED TO COMPLETE THE INSTALLATION OF FIBER-OPTIC CABLE NETWORK INFRASTRUCTURE FOR THE NEW FIRE STATIONS AND WASTEWATER TREATMENT FACILITY, AS AUTHORIZED BY SECTION 603 (A) OF THE AMERICAN RESCUE PLAN ACT AND U.S. TREASURY FINAL RULE 31 CFR 35 WHEREAS, on March 11, 2021, President Biden signed the U.S. Senate-amended H.R. 1319 (P.L. 117-2) known as the American WHEREAS, on May 10, 2021, the U.S. Treasury issued the Interim Final Rule to WHEREAS, by Ordinance No. 9931, approved on May 17, 2021, the City Council established Project No. CI-2113 and budgeted and appropriated up to $36.7 million in funds which were expected to be distributed to the City from ARPA for covered costs and eligible expenses to be incurred during the period which began on March 3, 2021, until December 31, 2024 (to be expended by December 31, 2026); and WHEREAS, on January 6, 2022, the U.S. Treasury issued, with an effective date of April 1, 2022, the Final Rule to implement ARPA in Title 31, Part 35 of the CFR; and WHEREAS, under the Final Rule, recipients may use Coronavirus State and Local -19 public health emergency and the negative economic consequences resulting therefrom; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that SECTION 1. Funds in the amount of Two Hundred, Fifty-Five Thousand Dollars and 00/100 ($255,000.00) are hereby authorized for payment from Project No. CI-2113 American Rescue Plan Act, for purposes of implementing fiber-optic network infrastructure required to provide technological services for mission-critical public safety operations into and out of their new facilities. SECTION 2. The officers and staff of the City are authorized to perform all acts consistent with this Resolution to implement the policies and procedures described herein. SECTION 3. This Resolution shall become effective immediately upon final passage. CI-2113 - AMERICAN RESCUE PLAN ACT, FOR THE PURPOSES OF ACQUIRING THE MANDATORY RAILROAD PERMITS NEEDED TO COMPLETE THE INSTALLATION OF FIBER-OPTIC CABLE NETWORK INFRASTRUCTURE FOR THE NEW FIRE STATIONS AND WASTEWATER TREATMENT FACILITY, AS AUTHORIZED BY SECTION 603 (A) OF THE AMERICAN RESCUE PLAN ACT AND U.S. TREASURY FINAL RULE 31 CFR 35 SUMMARY: This Resolution authorizes the payment of $255,000 in American Rescue Plan Act bring fiber-optic network infrastructure to the new Fire Stations and Wastewater Treatment Facility. PREVIOUS COUNCIL ACTION: By Ordinance No. 9931, approved on May 17, 2021, the City Council established Project No. CI-2113 and budgeted and appropriated up to $36.7 million in funds which were expected to be distributed to the City from ARPA funds for covered costs and eligible expenses to be incurred during the period which began on March 3, 2021, until December 31, 2024, (to be expended by December 31, 2026). BACKGROUND: In 2023, City Council approved several fiber-optic network infrastructure projects re joint fiber project with Pueblo County for the new county jail. This infrastructure is required to connect the technological infrastructure necessary to support the business operations of each agency upon opening. In the past, City I.T. was allowed to use, upon (CDOT) network as well as the use of empty conduit space within a local telecommunic the LEC have changed their policies related to this past practice. Due to this change, a reroute of the secondary network path for Fire Station 11 and the jail is required. Further, a 500 ft. bore under the railroad line is needed to complete the new Fire Station 6 and Wastewater Treatment project. It is anticipated up to three (3) additional railroad permits may be necessary. The costs include the permitting and licensing agreement, the railroad flaggers and inspectors required during installation, and the traffic control related to each of the bore sites. Railroad permits can only be held by one party, and the permits required are within City limits; therefore, the City of Pueblo will be future growth and needs in these areas. The costs associated with broadband infrastructure are related to the protection of mission-critical public safety applications, which is an eligible use of ARPA funds per 31 C.F.R. 35.6(b)(3)(ii)(E)(4). FINANCIAL IMPLICATIONS: Sufficient funds exist in the Project to cover the costs for the fiber optic cable network infrastructure. BOARD/COMMISSION RECOMMENDATION: Not applicable to this Resolution. STAKEHOLDER PROCESS: Not applicable to this Resolution. ALTERNATIVES: The City Council could decide not to support or fund the permitting needs preventing these new facilities conducting their business operations through electronic means and compromising public safety services and calls for service for our citizens.
