ORDINANCE NO. 6890
AN ORDINANCE ANNEXING THE AREA
COMMONLY KNOWN AND DESCRIBED AS WEST
OF PUEBLO BOULEVARD BETWEEN WEST 10
STREET AND NATURE CENTER DRIVE
WHEREAS, the City Planning and Zoning Commission has recommended
that the area described in Section 1 hereof be annexed to the City of Pueblo; and
WHEREAS, the City Council has heretofore found and determined by
Resolution that the Petition for Annexation and the area described in Section 1
hereof to be in compliance with the notice and other applicable provisions of the
Municipal Annexation Act of 1965 and C.R.S. §31 -12 -104, 105 and 107(1); and
WHEREAS, the City Council has by Resolution found and determined that
an election is not required under C.R.S. §31 -12 -107 (2) and no additional terms
and conditions are to be imposed upon the area described in Section 1 other
than those set forth in the Petition for Annexation and the Annexation Agreement;
NOW,THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The following described area situated in Pueblo County, Colorado, is
hereby annexed to Pueblo, a Municipal Corporation, subject to the terms and
conditions set forth in the Petition For Annexation, and the Annexation
Agreement which is hereby approved, and the official map of the City shall be
amended to show such annexation:
A Portion of Block 51 Westside Addition together with a portion of 10
Street and Nature Center Drive located within the SE %4 of Section 28, Township
20 South, Range 65 West, of the 6 th P.M. Pueblo County, State of Colorado and
being more particularly described as follows: Beginning at the Southeast corner
of Block 42 of said Westside Addition; Thence S 01 43' 44" E a distance of
168.23 Feet to the most Southerly corner of a parcel of land described in Book
1699 at Page 167 of the Pueblo County Records; Thence S 12 07' 24" W a
distance of 22.02 Feet to the Southeast corner of a parcel of land described in
Book 1875 at Page 328 of the Pueblo County Records; Thence S 29 39'37" E a
distance of 39.61 Feet to apparent Southeasterly R -O -W of Nature Center Drive;
Thence S 58 04' 24" W along said R -O -W a distance of 317.29 Feet; Thence N
29 39' 37" W a distance of 52.16 Feet to the West line of said Block 51; Thence
N 01 54' 36" W along said West line a distance of 338.15 Feet to the South line
of Block 42; Thence N 88 16'47" E along said South line Block 42 a distance of
286.45 Feet to the Point of Beginning. Said Area to be Annexed containing 2.06
acres more or less.
SECTION 2.
Within thirty (30) days after the effective date of the Ordinance, the City Clerk
shall:
(a) File one copy of the annexation map with the original of this ordinance in the
office of the City Clerk;
(b) File two certified copies of this ordinance and annexation map with the
Pueblo County Clerk and Recorder;
(c) File one certified copy of the annexation map and this Ordinance with the
Southeastern Colorado Water Conservancy District.
SECTION 3.
The City Council hereby consents to the inclusion of the annexed area in
the Southeastern Water Conservancy District pursuant to C.R.S. § 37-45 -136
(3.6).
SFCTION 4
This ordinance shall become effective immediately upon final passage and
the annexation shall be effective for ad valorem tax purposes on and after
January 1, 2003.
