HomeMy WebLinkAbout06851ORDINANCE NO. 6851 AN ORDINANCE IMPOSING A MORATORIUM ON THE ISSUANCE OF PERMITS FOR THE PLACEMENT OR INSTALLATION OF SINGLE FAMILY MANUFACTURED HOMES ON INDIVIDUALLY OWNED OR TO BE OWNED LOTS WITH FRONT ENTRANCES FACING ADJACENT LOTS AND NOT FACING PUBLIC STREETS FOR A PERIOD NOT TO EXCEED FIVE MONTHS WHEREAS, City administration has been and is activity pursuing the preparation and adoption of an ordinance establishing manufactured homes performance standards which, in part, restrict the installation or placement of manufactured homes on individually owned or to be owned lots with front entrances facing adjacent lots and not facing public streets, and WHEREAS, imposing a moratorium on the issuance of permits for the placement or installation of single family manufactured homes on individually owned or to be owned lots with front entrances facing adjacent lots and not facing public streets for a period of five months or until the adoption of performance standards for manufactured homes, whichever occurs first, would be in the best interest of the people of the City of Pueblo and would promote the public health, safety, morals, and welfare of the residents of the City of Pueblo. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The City Council of the City of Pueblo does hereby find and determine: 1. Performance standards for manufactured homes will promote the public health, safety, morals, and welfare of the residents of the City of Pueblo. 2. City administration has been and is actively pursuing the preparation and adoption of an ordinance establishing performance standards for manufactured homes. 3. The unrestricted installation and placement of single family manufactured homes on individually owned or to be owned lots with front entrances facing adjacent lots and not facing public streets is injurious to neighborhood aesthetics and property values, aggravates traffic problems and hazards, impairs and hinders the quality and sound development and growth of the City of Pueblo, infringes upon the privacy of adjoining property owners, and aggravates public safety problems. SECTION 2. No permit for the placement or installation of any single family manufactured home on an individually owned or to be owned lot with front entrance facing adjacent lots and not facing public streets shall be approved by an administrative official of the City of Pueblo or issued by the Pueblo Regional Building Department for a period of five (5) months from the effective date of this Ordinance or until performance standards for manufactured homes are adopted, whichever occurs first. SECTION 3. If any provision of this Ordinance shall be held invalid or unenforceable by any court of competent jurisdiction, such holding shall not invalidate or render unenforceable any other provision hereof. SECTION 4. This Ordinance shall become effective upon final approval and passage.
