TITLE
AN ORDINANCE CHANGING ZONING RESTRICTIONS FROM B -2 TO R -3
COVERING A PARCEL OF LAND COMMONLY KNOWN AS 409 +411 WEST 24
STREET
ISSUE
Shall City Council approve a request to rezone the property to an R-4 Zone District
that will allow the applicant to obtain financing on an existing four -plex, which has a
legal non - conforming use certificate, to be zoned within a district that allows multi-
family residential uses?
RECOMMENDATION
The Planning and Zoning Commission voted 6 -0 to recommended approval of the
rezoning.
BACKGROUND
The applicant is requesting that his property be rezoned from a B -1 neighborhood
commercial zone district to an R -4 multi - family zone district. The property currently
has an existing four -plex, which has a legal non - conforming use certificate. The
land proposed for rezoning has R-4 multi - family zone districts to the north, east,
and west and B-4 zoning to the south. The applicant is aware that rezoning to an
R-4 zone district will require that the property come into compliance with the
landscape performance standards of that zone district.
