AN ORDINANCE CHANGING ZONING RESTRICTIONS
FROM H.B. TO B -4 COVERING A PARCEL OF LAND
COMMONLY KNOWN AS 2101 EAST EVANS AVENUE
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The zoning restrictions covering the following described property be changed
from H.B., Historic Business Zone District, to B -4, Regional Business District, and upon
passage of this ordinance, zoning restrictions affecting B -4, Regional Business District
shall apply to said property:
LOTS 41 TO 44 INC BLK 37 LAKE MINNEQUA ADD,
and more commonly known as:
2101 EAST EVANS AVENUE.
SECTION 2.
(a) This ordinance is approved upon the following conditions:
(1) The owner of the property shall be required to pave and stripe the off - street
parking area.
(2) The owner of the property shall comply with Section 17 -4 -7 Landscape
Performance Standard of the Pueblo Municipal Code.
(b) If the above conditions are not completed within a reasonable period not to exceed
six months from the effective date of this Ordinance, the Planning and Zoning
Commission shall institute proceedings to rezone the property to B -4, Regional
Business District.
SECTION 3.
This ordinance shall become effective immediately upon final passage and approval.

AN ORDINANCE CHANGING ZONING RESTRICTIONS FROM H.B. TO B-4 COVERING A
PARCEL OF LAND COMMONLY KNOWN AS 2101 EAST EVANS AVENUE
ISSUE
Shall City Council approve a request to rezone the property to B-4 Commercial Zone District
that will allow the applicant to renovate an older building for apartments and retail.
RECOMMENDATION
The Planning and Zoning Commission voted 6 -0 to recommend approval of the rezoning.
BACKGROUND
The applicant is proposing to have the property rezoned from a Historic Business Zone
District (HB) to a Regional Business District (B-4) to renovate an older building and use it for
apartments and possibly a mixed use project. The applicant will be required to request a
Special Use Permit from the Zoning Board of Appeals before constructing apartments in this
structure.
The applicant recently rezoned this building to a Historic Business Zone District but was
unable to comply with all of the strict architectural standards set forth in the architectural
guidelines.
