HomeMy WebLinkAbout06822ORDINANCE NO. 6822 AN ORDINANCE APPROVING A MINI GRANT AGREEMENT BETWEEN THE CITY OF PUEBLO, A MUNICIPAL CORPORATION, AND THE STATE BOARD OF THE GREAT OUTDOORS COLORADO TRUST FUND RELATING TO THE GREENWAY AND NATURE CENTER OF PUEBLO'S EDUCATION, EVENT AND PICNIC SHELTER, AND AUTHORIZING THE PRESIDENT OF COUNCIL TO EXECUTE SAME WHEREAS, the City of Pueblo has received a $9,615 mini grant from the State Board of the Great Outdoors Colorado Trust Fund (GOCO) for the Greenway and Nature Center of Pueblo's Education, Event and Picnic Shelter (Project No. 2327), subject to the execution of a grant agreement; and BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. A Mini Grant Agreement between the City of Pueblo, a Municipal Corporation, and GOCO for the Greenway and Nature Center of Pueblo's Education, Event and Picnic Shelter, Project No. 2327, a copy of which is attached hereto having been approved as to form by the City Attorney, is hereby approved. SECTION 2. The President of City Council is hereby authorized to execute and deliver said contract in the name of and on behalf of the City of Pueblo, a Municipal Corporation, and the City Clerk shall affix the seal of the City thereto and attest the same. SECTION 3. A capital improvement project in the approximate cost of $16,615 known as the Nature Center Shelter is hereby established, funding for the project will be $9,615 from GOCO and $7,000 from the Greenway and Nature Center of Pueblo. RECOMMENDATION Approval of the Ordinance. BACKGROUND The City of Pueblo will be committing to complete the Education, Event and Picnic Shelter at the Nature Center. The City has received a $9,615 mini grant from GOCO. The Nature Center will provide $7,000 in cash match. The project consists of constructing a 1,500 square foot picnic shelter that will be used for educational programs, special events and family picnics. Design, site preparation and construction of the concrete floor and steel supports have already been completed. This phase of the project only includes the construction of the shelter's roof. The estimated budget for the project is $16,615, which includes the following funding sources: $9,615 GOCO 7,000 Nature Center miscellaneous funds, donations and grants received $16,615 TOTAL COST The Nature Center will also provide an additional $2,900 in value from in -kind services /donations. FINANCIAL IMPACT The City of Pueblo will receive a $9,615 payment from GOCO upon the completion of the project. The Nature Center currently has their portion of the funds in their project account. The City is not providing a cash match for this project. City is obligated under the grant agreement to maintain the facility for its useful life or at least 20 years. The nature center is the most popular access point for users of the Greenway Trail that runs through Pueblo. Design work, site preparation, and construction of the cement slab and metal supports has already been completed. This phase will complete the project and consists of constructing the shelter's roofing. Grantee applied to the Board pursuant to a Mini -Grant program established to provide financial assistance to communities that require a small immediate investment to enhance parks, outdoor recreation and environmental education facilities. On December 12, 2001, the Board awarded a sum not to exceed $9,615.00 for completion of the project entitled and described above (the "Project "). Grantee has up to two years to complete the project, or prior to December 12, 2003. Grantee agrees to use Board funds and Grantee's match solely to complete the Project as described in the application. Grantee has undertaken the responsibility for obtaining the match (funds and in -kind contributions) described in the project application. In addition, Grantee agrees to the general terms and conditions stated on the opposite side of this document. Grantee will complete project prior to December 12, 2003. Any extension beyond this date must be requested through a formal resolution. Projects not completed in a timely manner are subject to deauthorization, as stated in the "Overdue Grants Policy." 3. Funding may be used only for fixed assets. GOCO funds may not be used for administrative costs, design costs or non -fixed assets. 4. Grantee will erect signs approved by GOCO staff acknowledging Great Outdoors Colorado and the Colorado Lottery contribution to the Project. 5. Grantee agrees to allow reasonable public access and provide maintenance for the useful life of the Project, or at . least 20 years. The Board shall not be liable for any cost of maintenance or management or operation of the facility. 6. The Board may withdraw its approval of funding-- to4he- Grantee if, in its sole discretion, it determines conditions have occurred which fundamentally change the expectations of the Parties or make the Project infeasible or impractical. 7.. Grantee is an independent contractor acting in its separate capacity and not as an officer, employee or agent of the Board. 8. Grantee shall maintain standard financial accounting records relating to the Project for five years and provide the Board or its representatives or 10. The following provision applies to the Board and may also apply to the to the Grantee if the Grantee qualifies for protection under the Colorado Governmental Immunity Act, C.R.S. §24 -10 -101 et seq The Parties by entering into the instant agreement, do not waive or intend to waive by any provision of this agreement, the monetary limitations (presently $150,000 per person and $600,000 per occurrence) or any other rights, immunities, and protections provided by the Colorado Governmental Immunity Act, C.R.S. §24 -10 -101 et.seg as it is from time to time amended, or otherwise available to the Grantee,' its successor, employees, officers or agents. 11. To the extent permitted by law, the Grantee shall. be responsible for, indemnify and hold harmless the Board, its officers,_ agents and employees from any and all liabilities, claims,. demands, damages or costs resulting growing - out of, or m anyway connected with or incident to this Agreement, except for the gross negligence of willful and wanton conduct of the Board its officers, agents, or employees. Grantee hereby waives any and all rights to any type of express or implied indemnity or right of contribution from the State of Colorado, the Board, its officers, agents or employees, for any liability resulting from, growing out of, or in any way connected with or incident to. this Agreement.
