AN ORDINANCE CHANGING ZONING RESTRICTIONS
FROM B -1 TO R -4 COVERING A PARCEL OF LAND
COMMONLY KNOWN AS 415 NORTH FOUNTAIN AVENUE
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The zoning restrictions covering the following described property be changed from
B -1, Neighborhood Business District, to R -4, Mixed Residential District, and upon passage
of this ordinance, zoning restrictions affecting R -4, Mixed Residential District shall apply to
said property:
SOUTH 60 FEET LOTS 1 -2, BLOCK 23, EAST PUEBLO SUBDIVISION,
and more commonly known as:
415 NORTH FOUNTAIN AVENUE.
SECTION 2.
The ordinance is approved upon the following condition:
Applicant shall comply with the provisions of the City Code of Ordinances
Sec. 17 -4 -7, Landscape Performance Standard.
If this condition is not completed within a reasonable period not to exceed six months
form the effective date of this Ordinance, the Planning and Zoning Commission shall
institute proceedings to rezone the property to B -1, Neighborhood Business District.
SECTION 3.
This ordinance shall become effective immediately upon final passage and approval.

FOUNTAIN AVENUE
ISSUE
Shall City Council approve a request to rezone the property to an R -4 Zone District that
will allow the applicant to obtain financing on an existing four -plex, which has a legal non-
conforming use certificate, to be zoned within a district that allows multi - family residential
uses?
RECOMMENDATION
The Planning and Zoning Commission voted 6 -0 to recommended approval of the rezoning.
BACKGROUND
The applicant is requesting that his property be rezoned from a B -1 neighborhood
commercial zone district to an R -4 multi - family zone district. The property currently has
an existing four -plex, which has a legal non - conforming use certificate. The land proposed
for rezoning has R -4 multi - family zone districts to the north, east, and west and B -4 zoning
to the south. The applicant is aware that rezoning to an R -4 zone district will require that
the property come into compliance with the landscape performance standards of that zone
district.
