AN ORDINANCE ESTABLISHING A CAPITAL
IMPROVEMENT PROJECT IN THE APPDXIMATE
COST OF $8,776,000 AND BUDGETING,
APPROPRIATING AND TRANSFERRING $4,492,000
FROM GENERAL FUND SURPLUS TO THE
CAPITAL IMPROVEMENT FUND FOR THE
ARKANSAS RIVER CORRIDOR LEGACY PROJECT
WHEREAS, City Council supported an application to Great Outdoors Colorado to secure
funding for the Arkansas River Corridor Legacy Project.
WHEREAS, City Council supported an application to the U.S. Army Corps of Engineers
to secure funding for the Arkansas River Fisheries Habitat Restoration Project and be the Local
Project Sponsor; and
WHEREAS, the City of Pueblo received notification from the U.S. Army Corps of
Engineers in October 2001 that the Arkansas River Fisheries Habitat Restoration Project was
approved for design and construction.
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
A capital improvement project in the approximate cost of $8,776,000 known as the .
Arkansas River Corridor Legacy Project is hereby established.
SECTION 2.
Upon the recommendation of the City Manager and certification by the Director of
Finance that there is available cash surplus to meet such appropriation, $4,492,000 is hereby
budgeted and appropriated from general fund surplus and transferred to the Capital Improvement
Fund for the Arkansas River Corridor Legacy Project to be expended as follows: FY2002
$814,000; FY2003 $1,903,000, and FY2004 $1,775,000. Funds from partners in the Arkansas
River Corridor Legacy Project shall upon receipt by the City be transferred to the General Fund.
SECTION 3.
This Ordinance shall not be effective until the City of Pueblo enters into a Project
Cooperation Agreement with the U.S. Army Corps of Engineers for the Arkansas River Habitat
Restoration Project during fiscal year 2002.

Project Number:
rho Arkansas River legacy project has two phases and each phase has several projects. The projects wit be constructed under different contrails according
to funding sources. Phase 1 includes: Arkansas River fishery restoration, Environmental Plaza at the Nature Center, 5 miles of river trail improvements, two
wtdoor ad. sites at Lake Pueblo, and a river otter exhibit at the Zoo. Phase 2 Includes: 4 -acre riverpark at 4th Street, trail from Lake Pueblo to Pueblo West,
flight cages at the Raptor Center, and habitat Improvements at the Nature Center, and a river access from s Penn Street.

Should City Council budget and appropriate $8,776,000 to the Capital Improvement Fund
for the Arkansas River Corridor Legacy Project and transfer $4,492,000 from General Fund
Surplus to the project per schedule of need by fiscal year?
RECOMMENDATION
Approval of the Ordinance.
BACKGROUND
The City of Pueblo is the Project Sponsor of the Arkansas River Corridor Legacy Project
which includes the construction of a River Habitat Project on the Arkansas River that
includes the development of a fish passage structure that will also function as a recreational
boating course, improvements at the Greenway and Nature Center of Pueblo, a River Otter
Exhibit at the Pueblo Zoo, improvements to the Arkansas River Trail System,
environmental education sites at Lake Pueblo State Wildlife Area, and a riverfront park and
access along the river levee. The City is entering into a Project Cooperation Agreement
with the Army Corps of Engineers that will provide $4,284,000 in federal funds to the
River Habitat Project. The Army Corps of Engineers will spend $929,000 prior to the
construction of the River Restoration Project for the environmental analysis, ecological
restoration report, final design, specifications, and project bid documents. The South
Pacific Division of the Army Corps of Engineers has committed the balance of $3,355,000
in construction funds (see attached email from Army Corps). The $3,355,000 in federal
construction funds will be provided as follows: FY02 $142,000; FY03 $2,000,000; FY04
$1,038,000; FY05 $35,000 and final balance to complete project of $140,000.
Following the commitment of federal funds, the City will enter into a grant agreement with
Great Outdoors Colorado to provide $2,000,000 in funds for the project. The City will be
required to front the $2,000,000 of the GOCO grant funds. GOCO will reimburse the City
funds on an annual basis based on the City submitting documented project expenses in each
of the fiscal years. The City will also enter into separate agreements with Colorado State
Parks, Colorado Division of Wildlife, Pueblo County, Greenway and Nature Center, Inc.,
and the Pueblo Zoological Society to secure the matching funds and grant obligations and
requirements for each of the components of the project. The project construction period is
three years beginning in June, 2002 through June 2005. Except for the $400,000 in City
funds, the partner funds will replenish the City's commitment of $4,492,000.
The River Habitat project includes the construction of a series of aquatic habitat structures,
construction of a low water channel, the realignment of the river in two locations, and the
planting of riparian vegetation along a 9 -mile section of the Arkansas River between
Pueblo Dam and Fountain Creek. The project also includes the construction of a fish
passage ladder below the West Plains Diversion Dam that will be built to function as a boat
passage and kayak course. These improvements provide the basis for the minimum stream
flow filing for the Arkansas River that was filed by the City of Pueblo. In May, 2000, the
City received a commitment of Great Outdoors Colorado Legacy funding for the Arkansas
River Corridor Legacy Project. The habitat project is projected to utilize $1,310,000 of
these funds as local matching funds to the U.S. Army Corps of Engineers. In October,
2001 the U.S. Army Corps of Engineers approved the Ecosystem Restoration Report and
Environmental Analysis and approved the project for final design and construction. The
projected construction schedule is from November 2002 through October 2004.
The establishment of a capital project account and the transferring of general fund surplus
revenue to the Arkansas River Legacy Project are required prior to the City entering into
the Project Cooperation Agreement with the Army Corps of Engineers. The City will also
be receiving funding from Pueblo County, Colorado State Parks, Colorado Division of
Wildlife, and Trout Unlimited that will be applied to Local Project Sponsor matching
funds.
FINANCIAL IMPACT
The transfer of $4,492,000 in general fund surplus revenue into the Capital Improvement
Fund for the Arkansas River Corridor Legacy will provide the revenue to comply with the
provisions of the Army Corps of Engineers Project Cooperation Agreement and provide
total funding for other elements of the project as listed in the capital project budget sheets.
The $4,492,000 in general funds will be provided as follows: FY2002 $814,000; FY2003
$1,903,000; and FY2004 $1,775,000.
All but $400,000 is expected to be reimbursed by our partners based on the following
schedule:

These fiords will be requested early in the project so as to minimize the impact on the
City's General Fund. In addition to the project construction costs, the Project Cooperation
Agreement will require the City of Pueblo to maintain the habitat improvements over the
project life, which is identified in the Arkansas River Fisheries Habitat Restoration — Final
Ecosystem Restoration Report as 40 years. The estimated annual amortized maintenance
cost is $25,400.00.
