HomeMy WebLinkAbout06798ORDINANCE NO. 6798 AN ORDINANCE CHANGING ZONING RESTRICTIONS FROM S -1 TO R -2 AND R -2 TO S -1 COVERING A PARCEL OF LAND COMMONLY KNOWN AS EAST OF WILLS BOULEVARD AND NORTH WEST OF NORTH DRIVE BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The zoning restrictions covering the following described property be changed from S -1, Governmental Use District, to a R -2, Single - Family Residential District and from R -2, Single - Family Residential District, to S -1, Governmental Use District, and upon passage of this ordinance, zoning restrictions affecting S -1, Governmental Use District and R -2 Single - Family Residential District shall apply to said property: S -1 TO R -2 A parcel of land in the SW '/4 of the SW '/4 of Section 11, Township 20 South, Range 65 West of the 6` P.M. in the County of Pueblo, State of Colorado, being a portion of that tract of land conveyed to the Pueblo Board of Water Works by deed recorded in Book 1478 at Page 443 of the Pueblo County records and being more particularly described as follows: Considering the North line of the SW ' / 4 of said Section 11 to bear N. 89 °48'03" W. and all bearings contained herein being relative thereto. Commencing at the Southwest corner of said tract of land; thence N. 03 °09'05" E., along the West line of said tract of land, a distance of 72.83 feet to the True Point of Beginning of the parcel of land herein described; thence N. 03 °09'05" E., along said West line, a distance of 236.86 feet; thence Southeasterly, along the arc of a curve to the left whose center bears S. 86 0 50'53" E. and whose radius is 200 feet, a distance of 173.91 feet; thence S. 43 0 19'45" W., a distance of 110.00 feet to the Point of Beginning. Containing 0.144 acres (6294.20 sq.ft.). R -2 TO S -1 A parcel of land in the SW '/4 of the SW '/a of Section 11, Township 20 South, Range 65 West of the 6 th P.M in the County of Pueblo, State of Colorado and being more particulary described as follows: Considering the North line of the SW ' / 4 of said Section 11 to bear N. 89 0 48'03" W. and all bearings contained herein being relative thereto. Commencing at the Southwest corner of that tract of land conveyed to the Pueblo Board of Water Works by deed recorded in Book 1478 at Page 443 of the Pueblo County records; thence N. 03 °09'05" E., along the West line of said tract of land, a distance of 72.83 feet to the True Point of Beginning of the parcel of land herein described; thence S. 43 °19'45" W., a distance of 13.59 feet; thence South - easterly, along the arc of a curve to the left whose center bears N. 43 °08'28" E. and whose radius is 300 feet, a distance of 11.27 feet to the West line of said tract of land; thence N. 03 °09'05" E., along said West line, a distance of 17.46 feet to the Point of Beginning. Containing 0.002 acres (76.92 sq.ft.). SECTION 2. RECOMMENDATION The Planning and Zoning Commission voted 7 -0 to recommended approval of the rezoning from an S -1 zone to a R -2 zone and a R -2 zone to a S -1 zone. BACKGROUND The applicant Mesquite LLC, also acting on behalf of the Pueblo Board of Water Works, is requesting to rezone properties they are being exchanged to the proper zone district to allow for Single - Family Residential (R -2) development on the Mesquite LLC parcel, and Governmental Use (S -1) on BOWW parcel. The property owned by Mesquite LLC totals .002 acres and the property owned by the Pueblo Board of Water Works totals .144 acres. The rezoning application is being submitted concurrently with the final plat for Crestview Hills Subdivision Second Filing. FINANCIAL IMPACT None
