HomeMy WebLinkAbout09824RESOLUTION NO. 9824 A RESOLUTION CALLING A SPECIAL MUNICIPAL ELECTION TO BE HELD ON TUESDAY, APRIL 22, 2003 AND SUBMITTING TO THE REGISTERED ELECTORS OF THE CITY OF PUEBLO A QUESTION ON ORDINANCE NO. 6921 ENACTING THE PUEBLO SMOKE-FREE AIR ACT OF 2002 AND THE RECALL OF COUNClLPERSONS BILL SOVA AND MIKE OCCHIATO WHEREAS, Petitions have been filed with the City Clerk containing sufficient signatures of qualified electors to require the City Council pursuant to Section 18-3 of the Charter to either repeal Ordinance No. 6921 Enacting the Pueblo Smoke-Free Air Act of 2002 or to submit the Ordinance to a vote of the people; and WHEREAS, Petitions have been filed with the City Clerk containing sufficient signatures of registered electors demanding the recall of Councilpersons Bill Sova and Mike Occhiato and a special election on their recall may be required to be called pursuant to Section 18-3 of the Charter. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. A special municipal election of the City of Pueblo, a municipal corporation is hereby called for April 22, 2003. SECTION 2. At said special municipal election there shall be submitted to a vote of the registered electors a question with respect to Ordinance No. 6921. The ballot for the question is hereby fixed to read: SHALL ORDINANCE NO. 6921 ENACTING THE PUEBLO SMOKE- FREE ACT OF 2002 BE APPROVED? FOR THE ORDINANCE AGAINST THE ORDINANCE SECTION 3. At said special municipal election there shall be submitted to a vote of the registered electors the recall of Councilpersons Bill Sova and Mike Occhiato. The ballot titles for the recall are hereby fixed to read: SHALL BILL SOVA BE RECALLED FROM THE OFFICE OF CITY COUNCIL? YES NO SHALL MIKE OCCHIATO BE RECALLED FROM THE OFFICE OF CITY COUNCIL? YES NO SECTION 4. The City Council does hereby adopt the optional registration plan provided in Section 17-9 of the Charter of the City of Pueblo and hereby determines and declares that voting machines are not available and all votes at the special municipal election shall be taken, recorded and tabulated by the use of an electronic voting system. SECTION 5. All public notices required to be published with respect to the special municipal election shall be published in the Pueblo Chieftain. SECTION 6. The City Clerk and the Board of Elections are authorized and directed to take all action necessary, appropriate or required to hold and conduct the special municipal election. SECTION 7. This Resolution shall become effective upon final approval but shall be deemed cancelled and repealed if the City Council adopts the Resolution of Intent To Repeal Ordinance No. 6921 Enacting The Pueblo Smoke-Free Air Act Of 2002 And To Adopt A Compromise Smoke-Free Ordinance and the representatives of the signers of the recall petitions designated in the recall petitions for councilpersons Bill Soya, Mike Occhiato, Robert Schilling, and Ted Lopez, Jr. ("Recall Petitions") file in the office of the City Clerk on or before March 26, 2003 documents, approved as to form by the City Attorney, withdrawing all the Recall Petitions and cancelling the recall election.
