A portion of Del Norte Avenue as platted in Sunny Heights Subdivision, Third Filing, County of Pueblo. State of Colorado, being more particularly described as follows: BEGINNING at the southwesterly corner of Lot Twenty (20), Block Three (3), said Sunny Heights Subdivision, Third Filing, said point being on a curve, from which the center of said curve bears S31 °47'01 "W; THENCE, northwesterly along said curve to the left having a radius of 760.00 feet, through a central angle of 03 0 46'20 ", a distance of 50.04 feet to the northwesterly right -of -way line of said Del Norte Avenue; THENCE, N31 0 47'01 "E along said northwesterly right -of -way line, a distance of 84.22 feet to a point on a non - tangent curve, from which the center of said curve bears S05 0 53'00 "E; THENCE, easterly along said curve to the right having a radius of 295.00 feet, through a central angle of 05 0 04'58 ", a distance of 26.17 feet; THENCE, N89ol 1'58 "E a distance of 61.33 feet to a point on the southeasterly right -of -away line of said Del Norte Avenue, said point being on tangent curve, from which the center of said curve bears SOOo 48'02 "E; THENCE, southwesterly along said southeasterly right -of -way line and along said curve to the left having a radius of 50.00 feet, through a central angle of 57 °24'57, a distance of 50.10 feet; THENCE, S31 D47'01 "W a distance of 88.53 feet to the POINT OF BEGINNING. Said parcel contains 0.1178 acres, more or less. A PORTION OF Monte Vista Avenue as platted in Sunny Heights Subdivision, Third Filing, County of Pueblo, State of Colorado, being more particularly described as follows: BEGINNING at the southwesterly corner of Lot Three (3), Block Three (3), said Sunny Heights Subdivision, Third Filing, said point being on a curve, from which the center of said curve bears N22 0 45'22 "E, and being on the northerly right -of -way line of said Monte Vista Avenue; THENCE, southeasterly along said northerly right -of -way line and along said curve to the left having a radius of 573.64 feet, through a central angle of 13 °03' 17 ", a distance of 130.70 feet; THENCE, N87o23'29 "W a distance of 138.02 feet to the southwesterly extension of the common boundary line between Lots Three (3) and Four (4), Block Three (3) said Sunny Heights Subdivision, Third Filing: THENCE, N22 045'22" along said extension of the common boundary line, a distance of 32.71 feet to the POINT OF BEGINNING. Said parcel contains 0.0412 acres, more or less. are hereby vacated, reserving, however, to the City of Pueblo and utility owners the right at all times to repair, operate or replace existing utilities and sewer and water lines, and mains together with the right of ingress and egress to accomplish same. SECTION 2. The reservation set forth in Section 1 hereof shall automatically terminate upon recording in the Pueblo County Clerk and Recorder's office a verified statement of the Director of Public Works of the City of Pueblo certifying that all utilities and sewer and water lines, and mains existing in said streets have been removed or abandoned. SECTION 3. This ordinance shall become effective immediately upon final passage and approval. RECOMMENDATION The Planning and Zoning Commission voted 7 -0 to recommend approval of the public street vacations for portions of Del Norte Avenue and Monte Vista Avenue. BACKGROUND The applicant was required to submit the partial roadway vacations as one of the conditions of the Regency Crest Annexation Agreement. This plat vacates a portion of Monte Vista Avenue and also the dead -end stub of Del Norte Avenue south of Sage Street. The applicant was required to request a vacation of the portions of right -of -way within 90 days following the approval of the Regency Crest Annexation. The vacation of these portions of right -of -way are being done in preparation for the development of Regency Crest 3` Filing Subdivision. FINANCIAL IMPACT None
