PRAIRIE AVENUE BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The zoning restrictions covering the following described property be changed from S -1 Governmental Use District, to R -2, Single - Family Residential District, and upon passage of this ordinance, zoning restrictions affecting R -2, Single - Family Residential District shall apply to said property: Lots 1- 48, Block 4, Portis Place, and more commonly known as: 401 South Prairie Avenue. SECTION 2. With the recommendation of the Planning and zoning Commission, this zoning ordinance is approved with the following condition: Applicant shall secure a Special Use Permit that allows the operation of a childcare center in an R -2 Single - Family Residential Zone. If this condition is not completed within 90 days from the effective date of this Ordinance, the Planning and Zoning Commission shall institute proceedings to rezone the property to S -1, Governmental Use District. SECTION 3. This ordinance shall become effective immediately upon final passage and approval. PRAIRIE AVENUE ISSUE Shall City Council approve a request to rezone the property to an R -2 Zone District that will permit the applicant to operate a child care center on property that is not allowed under the existing zone? RECOMMENDATION The Planning and Zoning Commission voted 7 -0 to recommended approval of the rezoning from an S -1 zone to an R -2 zone with the following condition: Subject to a Special Use Permit being filed within 90 days. BACKGROUND The applicant is proposing to have the property rezoned from a Governmental Use District (S -1) to a Multiple - Residential and Office District (R -5) (revised to R -2, residential district) in order to have property properly zoned for the operation of a day care center. The single - family residences in the vicinity of the childcare facility are in an R -2 zone. The applicant will need to apply and receive a "use by review" to operate the childcare center within the R -2 zone. FINANCIAL IMPACT None
