HomeMy WebLinkAbout06778"AS AMENDED" ORDINANCE NO. 6778 AN ORDINANCE AMENDING SECTION 31 OF CHAPTER 3, TITLE XII OF THE PUEBLO MUNICIPAL CODE RELATING TO CURBS, GUTTERS, SIDEWALKS AND DRIVEWAYS AND REQUIRING BOND FOR CONSTRUCTION THEREOF BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: (brackets indicate matter deleted, underscoring indicates matter added) SECTION 1 Section 31 of Chapter 3, Title XII of the Pueblo Municipal Code is amended by adding the following subsections (f) and (g) thereto: Mf Any contractor who shall aggly for a permit to construct, remove, repair, or in any manner disturb any sidewalk, driveway, curb, gutter, or any combination thereof, on the public right -of -way shall post a bond in the penal sum of five thousand dollars ($5,000.00) with the Director of Public Works. The condition of such bond shall be that the permittee shall comply with all ordinances of the City and specifications of the Director of Public Works pertaining to the construction, removal, repair, or modification of sidewalks, driveways curbs, gutters or any combination thereof. Such bond shall be approved as to sufficiency by the Director of Public Works and by the City Attorney as to form and for each permit shall remain in full force and effect for the period from the date of the bond to two (2) years after the acceptance of the work by the Director of Public Works. JM In the event of the breach of any condition of the bond, the Director of Public Works shall give notice of such breach to the permittee and surety on the bond and shall cause the condition whereby the bond is breached to be remedied. The City Attorney shall bring action in the name of the City to recover the penalty of the bond or so much thereof as may be necessary to reimburse all costs and expenses incurred to correct or remedy the breach. SECTION 2 This Ordinance shall become effective upon final passage.
