HomeMy WebLinkAbout06777ORDINANCE NO. 6777 AN ORDINANCE CHANGING ZONING RESTRICTIONS FROM I -2 TO R -4 COVERING A PARCEL OF LAND COMMONLY KNOWN AS 625 EAST 9` STREET BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The zoning restrictions covering the following described property be changed from I -2, Light Industrial District, to R -4, Mixed Residential District, and upon passage of this ordinance, zoning restrictions affecting R -4, Mixed Residential District shall apply to said property: Lots 15 & 16, Block 92, Conleys Add Subdivision, and more commonly known as: 625 East 9` Street NcrerlrelnrA The ordinance is approved upon the following condition: • Applicant shall comply with the provisions of the City Code of Ordinances Sec. 17 -4 -7, Landscape Performance Standard. If this condition is not completed within a reasonable period not to exceed six months form the effective date of this Ordinance, the Planning and Zoning Commission shall institute proceedings to rezone the property to I -2, Light Industrial District. SECTION 3. This ordinance shall become effective immediately upon final passage and approval. RECOMMENDATION The Planning and Zoning Commission voted 7 -0 to recommended approval of the rezoning with the following conditions: 1. Applicant shall comply with the provisions of the City Code of Ordinances Sec. 17- 4-7 Landscape Performance Standard. BACKGROUND The applicant is proposing to have the property rezoned from a Light Industrial District (I- 2) to a Mixed Residential District (R -4) to permit development of a church on the property that is not allowed under the existing zone. The R -4 Zone District allows the operation of a church as a "use by right ". The site is located in an established single - family residential neighborhood. The property was previously the location of church and was previously rezoned to an industrial zone district. The existing structure on the property is currently vacant and in the process of being remodeled back into a church. FINANCIAL IMPACT None
