AN ORDINANCE CHANGING ZONING RESTRICTIONS
FROM B -4 TO R -4 COVERING A PARCEL OF LAND
COMMONLY KNOWN AS 1421 EAST EVANS AVENUE
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The zoning restrictions covering the following described property be changed from B -4,
Regional Business District, to R -4, Mixed Residential District, and upon passage of this
ordinance, zoning restrictions affecting R -4, Mixed Residential District shall apply to said
property:
Lot 17 + S 2 Ft OF W 43 FT OF 18 Block 4, Steelworks Amend Subdivision, and more
commonly known as:
1421 East Evans Avenue
SECTION 2.
The Ordinance is approved upon the following conditions:
1. Applicant shall be required pave and strip the off - street parking area.
2. Applicant shall be required to plant street trees in the public right -of -ways on Indiana
Avenue and Evans Avenue and the off - street parking lot, in lieu of complying with all
of the provisions of Section 17 -4 -7 Landscape Performance Standard.
If any of these conditions are not completed within a reasonable period not to exceed six
months from the effective date of this Ordinance, the Planning and Zoning Commission shall
institute proceedings to rezone the property to B -4 Regional Business District.
SECTION 3.
This -Ordinance shall become effective immediately upon final passage and approval.

COVERING A PARCEL OF LAND COMMONLY KNOWN AS 1421 EAST EVANS
AVENUE
ISSUE
Shall City Council approve a request to rezone the property to an R -4 Zone District that
will allow the applicant to secure financing for an existing four -plex that is currently
located in a B -4 Regional Business Zone District?
RECOMMENDATION
The Planning and Zoning Commission voted 7 -0 to recommended approval of the rezoning
with the following conditions:
1. The off - street parking area shall be paved and striped.
2. Applicant shall comply with the provisions of the City Code of Ordinances Sec. 17-
4-7 Landscape Performance Standard.
BACKGROUND
The applicant is proposing to have the property rezoned from a Regional Business District
(B -4) to a Mixed Residential District (R -4) in order to have property properly zoned for the
refinancing of the property. The R -4 Zone District allows the four -plex as a "use by right ".
This is the third rezoning in the past two -year of property located in the 1400 of East
Evans. All of the requests have been to rezone property from a business zone to a
residential zone for refinancing purposes.
